TEMPO.CO, Jakarta – Pengacara kondang Hotman Paris Hutapea memprotes besaran pajak barang dan jasa tertentu (PBJT) untuk jasa hiburan pada diskotek, karaoke, kelab malam, dan mandi uap atau spa. Direktorat Jenderal Pajak atau DJP Kementerian Keuangan buka suara soal ini.

Direktur Penyuluhan, Pelayanan, dan Hubungan Masyarakat DJP, Dwi Astuti, mengatakan pajak hiburan adalah kewenangan pemerintah daerah. Oleh sebab itu, dirinya tak bisa berkomentar terlalu banyak.

“Itu sudah mutlak kalau sesuai dengan Undang-undang HKPD (Hubungan Keuangan antara Pemerintah Pusat dan Pemerintah Daerah), yang tidak diatur pemerintah pusat itu adalah kewenangan sepenuhnya dari pemerintah daerah,” ujar Dwi saat ditemui di Kantor Pusat DJP, Jakarta Selatan pada Senin, 8 Januari 2024.

Sebagai informasi, Pasal 4 Ayat 2 UU HKPD menyatakan salah satu pajak yang dipungut oleh pemerintah kabupaten atau kota adalah pajak barang dan jasa tertentu alias PBJT.

Pasal 50 dalam beleid tersebut menyebut, objek PBJT adalah penjualan, penyerahan, dan/atau konsumsi barang dan jasa tertentu. Ini meliputi makanan dan/atau minuman, tenaga listrik, jasa perhotelan, jasa parkir, serta jasa kesenian dan hiburan.

Adapun Hotman Paris memprotes pajak hiburan lewat akun Instagram resminya @hotmanparisofficial pada akhir pekan lalu. “What? 40 sd 75 persen pajak?? What?? OMG (Kelangsungan industri pariwisata di Indonesia terancam),” tulisnya pada Sabtu, 6 Januari 2024.

Tak lupa, Hotman mengunggah tangkapan layar Pasal 57 hingga 59 dalam Undang-Undang Nomor 1 Tahun 2022 tentang HKPD. “Khusus tarif PBJT atas jasa hiburan pada diskotek, karaoke, kelab malam, bar, dan mandi uap atau spa ditetapkan paling rendah 40 persen dan paling tinggi 75 persen,” begitu bunyi Pasal 58 ayat 2 dalam unggahan Hotman.
