The Supreme Court on Tuesday ordered a medical examination for NewsClick founder, Prabir Purkayastha, who is currently incarcerated, by a board convened by the director of the All India Institute of Medical Sciences (AIIMS).Â

A bench of Justices BR Gavai and Sandeep Gupta said that the AIIMS panel will review the jail records along with Purkayastha’s comprehensive medical history.

The Supreme Court’s order was in response to the claims made on behalf of Purkayastha that the report by the Tihar Central Jail specialist medical officer does not accurately reflect his medical condition. The judicial body deemed it necessary for Purkayastha to undergo a more detailed medical assessment by a board of medical professionals. The court has decided to review this matter further in two weeks.

During the hearing, Senior Advocate Kapil Sibal, appearing for Purkayastha, made a remark after a pass-over was sought on behalf of Additional Solicitor General SV Raju.

“He shouldn’t pass away while you ask for a pass-over,” Sibal said.

After the court suggested that an independent medical examination by AIIMS can be conducted, Sibal said they have no issues with an AIIMS evaluation.

Responding to the ASG’s statement as to why the State should bear his medical expenses, the court said “Because he is your guest.”Â

The court also didn’t agree with ASG’s submission that this was a matter of principle and Purkayastha must bear the cost of his treatment, and shouldn’t get any special treatment.Â

The court said that such an argument cannot be raised since Purkayastha was in custody.Â

The court further orally remarked that Purkayastha can be released, and then he can get himself treated in the hospital that he wants.Â

The case lodged against Purkayastha is under the Unlawful Activities (Prevention) Act over allegations that NewsClick received money to spread pro-China propaganda.Â

On October 1, the Delhi Police arrested NewsClick founder Prabir Purkayastha and HR head Amit Chakravarty after it conducted raids at the homes of several journalists and employees linked to the online portal in connection with the UAPA case.Â
