It’s been three years since Akriti Sood, widow of Martyr Major Anoot Sood of the Rashtri Rifles, received the shore chakra from President of India Ramnath Kovind. Akriti Sood first moved the Bombay High Court in March 2024 after her letters to the state government and the Prime Minister written over the last three years went unanswered and the state government finally rejected her request. The Maharashtra government told the Bombay High Court that the rejection was on technical grounds that while Major Anuj Sood and his family lived in Pune at the time of his demise, he did not have a domicile certificate because he had not lived in the state for the required period of 15 years at the time. The court ordered the state government to under this a special case and process the benefits under both GRS, ITS said. And I quote, we are conscious of the fact that state government certainly can take lightning decisions on several issues and as compared to such decisions, the present issue is a small but needy issue. The concerned department and the higher officers of the state government need to be alive to the cause being pursued by the petitioner and in the light of the orders passed by us. However, the state government has now replied to the court saying it cannot do this since the decision will require policy changes for which cabinet approval is required and cabinet cannot meet when the Model Code of Conduct has kicked in ahead of the Lok Sabha elections. This has not gone down well with the Bombay High Court expressing unhappiness and surprise at this inaction. The court has given Chief Minister Eknath Shinde one week to decide on how to proceed. It has said that if the Chief Minister is unwilling to affect the benefits payout, he or his office have to file an affidavit to that effect, after which the court will take matters into its own hands.
