A Russian tycoon who stirred the ire of locals after erecting a fence around his £2.8million property has lost his bid to get permission to use an outbuilding on his estate as a residential dwelling, in a move welcomed by conservationists.

Ultrawealthy Alexander Mosionzhik has recently purchased the 30-acres Wymers estate in leafy Marlow Bottom and was interested in using an outbuilding located 50m away from the eight-bedroom main house for residential purposes.

Currently the 11m x 18m outbuilding includes toilets and a kitchenette, but it currently sits empty as well as the rest of the estate which is currently derelict and is supposedly undergoing extensive renovation work.

On December 4, Mr Mosionzhik asked Buckinghamshire County Council to give him a certificate which would say that he could lawfully use the outbuilding as a separate living quarters on the property.

His case is that previous owners of the estate had been putting the outbuilding to domestic use for almost 100 years.

Planning law states that if the used had been ongoing for at least 10 years, the council could not take enforcement action against it.

Mr Mosionzhik's agent has told Buckinghamshire County Council the previous owners of the estate have passed away and it is unknown what the outbuilding, which is at least 20 years old, was previously used for.

They provided the council with photographs which showed the building had been in use for domestic storage including furniture, appliances, wardrobes and books.

A conveyance of the site from June 1948, provided to the council, showed the building labelled as a 'Games Room'.

'The description of the building as a Games Room clearly indicates that it was in active used for domestic purposes ancillary to the main house prior to this time', an application submitted by chartered architects Danks Badnell said.

But planning officer Yee Chung Hui concluded that although the existing outbuilding and the 'games room' were located in similar places on maps, the existing outbuilding 'occupies a much greater building footprint'.

Hui said this 'suggested the two structures are not the identical and there is no evidence submitted to have suggest they are related'.

There were no maintenance or building receipts put forward to demonstrate the outbuilding had been in situ for 10 years, Hui said.

She added: 'The photo of storage is not conclusive, nor does it necessarily confirmed the stored items is related to a domestic use or storage on a commercial basis.

'Due to the insufficient evidence submitted, the ancillary use of the application outbuilding is not proven nor concluded.'

Mr Mosionzhik made his millions in business and was formerly chairman of the board of directors at Nafta Moskva, a Russian oil trading company.

He had previously caused controversy in Marlow Bottom over his plans to build a chain link fence around the perimeter of his property, which ultimately he succeeded in doing.

Commenting on his latest failed application, Richard Sherwin, the chairman of Save Marlow's Green Belt, a community group, said: 'Save Marlow's Greenbelt deplores all inappropriate development in the Greenbelt and is pleased that Buckinghamshire Council has taken this stance.

'Buckinghamshire Council has a strong track record of protecting the Greenbelt and we trust this will continue with the current application from property developers Dido who are looking to destroy 90 Acres of Marlow's greenbelt.'

He was referring to heavily-objected to plans lodged to build a film studios in Marlow, which Dido argue will create further growth in the film industry.

A spokesman for Buckinghamshire Council said: 'We can confirm that Buckinghamshire Council has refused a certificate of lawfulness application submitted to us, which was seeking approval to prove that an existing outbuilding has been used in breach of a planning condition for a period of over 10 years, therefore classifying the use of the building as lawful.

'Looking at the case, we have determined that the physical building is lawful, but the use of it isn't. At this stage, we haven't issued any formal enforcement action against the use of the building.'
