La Segunda Sala del Tribunal Constitucional resolvió convocar a alegatos de admisibilidad del requerimiento presentado por el general director de Carabineros, Ricardo Yáñez Reveco.

La instancia presidida por José Ignacio Vásquez Márquez, integrada además por María Pía Silva Gallinato, Raúl Mera Muñoz, Catalina Lagos Tschorne y Marcela Peredo Rojas, resolvió convocar a las partes a alegatos de admisibilidad para el martes 7 de mayo a las 13.00 horas.

El 4 de abril, a través de un escrito de 24 páginas, el jefe policial ingresó un requerimiento de inaplicabilidad por inconstitucionalidad en el Tribunal Constitucional, alegando que las actuaciones del Ministerio Público en el caso en su contra han implicado una serie de vicios que vulneran sus garantías.

El pasado 9 de abril el TC resolvió por unanimidad acoger a trámite el requerimiento y rechazar por mayoría de votos la solicitud de suspensión de su formalización. Además decidió que con posterioridad se pronunciaría sobre la admisibilidad del requerimiento.

Tras el crimen en que tres carabineros fueron emboscados, baleados y quemados en Cañete, el sábado 27 de abril, día del aniversario institucional, la Fiscalía Metropolitana Centro Norte pidió postergar la formalización del jefe de la policía uniformada que estaba fijada originalmente para el 7 de mayo. El 7° Juzgado de Garantía de Santiago accedió y reagendó la audiencia para el 1 de octubre.

El general quiere terminar su mandato de manera limpia. Sin embargo, su calidad de imputado por la fiscal Ximena Chong por su rol como jefe de Orden y Seguridad en el estallido social podría mermar estas pretensiones.

Yáñez fue designado en el cargo el 19 de noviembre de 2020, en el segundo gobierno de Sebastián Piñera, y asumió el mando seis días después. Así, el 25 de noviembre completaría su periodo constitucional de cuatro años.
