Los consumidores podrán seguir reclamando los gastos de sus hipotecas: el plazo no ha terminado

Los gastos de la hipoteca cobrados de forma abusiva por los bancos podrán seguir reclamándose. Así los establece el Tribunal de Justicia de la Unión Europea (TJUE) que se ha pronunciado al respecto este 25 de abril, y ha dado un duro golpe a los bancos que se escudaban en el que el plazo para las reclamaciones ya había vencido.

El plazo para reclamar los gastos de la hipoteca ha causado cierto revuelo en los últimos meses, ya que en un principio se establecía que podía reclamarse hasta 2019, después se estimaba que hasta el 14 abril de este 2024, y ahora el TJUE se pronuncia, poniéndose nuevamente de parte de los consumidores. 

Ya lo hizo en una sentencia pasada, y se reitera en que la fecha para empezar a contar cuando prescribe el plazo para reclamar los gastos cobrados de forma indebida por los bancos comienza cuando la persona hipotecada tiene conocimiento de que esas cláusulas no deberían haberse aplicado.

El tema ha sido controvertido, y es que ni la propia justicia llegaba a ponerse de acuerdo en sus sentencias, algo que el TJUE aclara en esta última sentencia. Según explican desde la Organización de Consumidores y Usuarios (OCU), el momento a partir del cual se puede empezar a contar el plazo para reclamar los gastos es en el que el consumidor sea consciente de ello, y ese momento será cuando se obtenga una sentencia en la que se declare nula la cláusula de su préstamo. 

Gastos que se pueden reclamar 

Para poder reclamar, las personas que firmaron su hipoteca antes del 16 de junio de 2019, fecha a partir de la cual entró en vigor la Ley de Crédito Inmobiliario tendrán que revisar si hicieron pagos por alguno de estos conceptos:

  • 50% gastos de notaría
  • 100% gastos de Registro de la Propiedad
  • 100% gastos de gestoría
  • 100% comisión de apertura
  • 100% tasación

Para poder reclamar, deberán disponer de documentos que acrediten el pago del banco y presentar una reclamación en su banco.
