Mais de dois anos depois do início da guerra na Ucrânia, o Conselho da Europa está a preparar um tribunal especial para poder julgar a Rússia pelo crime de agressão internacional. O desafio é grande e pode não resultar em alguma acusação ou detenção — mas isso “não deve impedir o esforço para garantir a justiça”. “Os Estados devem tomar todas as medidas para fazer com que essa agressão cesse”, defendem dois professores de Direito Internacional

O Conselho da Europa vai criar um tribunal especial para julgar o crime de agressão da Rússia contra a Ucrânia. Apesar de as conversações já estarem em curso desde 2022, os contornos deste tribunal são ainda vagos. A questão que se impõe é que jurisdição terá para conseguir, de facto, garantir a justiça e prender os líderes acusados.

A decisão foi elogiada pelo ministro dos Negócios Estrangeiros ucraniano, Dmytro Kuleba. “Esta importante decisão dá instruções à secretária-geral do Conselho da Europa para preparar os documentos necessários para facilitar as consultas no grupo central sobre o tribunal e o potencial projeto de um acordo entre a Ucrânia e o Conselho sobre a sua criação efetiva”, escreveu na rede social X (antigo Twitter).
