En la Sala del Senado se dio cuenta, el martes, del despacho que hizo la Cámara de Diputadas y Diputados del proyecto de Reglas de Uso de la Fuerza.

El proyecto será visto ahora en las comisiones -unidas- de Defensa y de Seguridad Pública de la Cámara Alta, sin la indicación de la justicia militar, que por un voto se declaró inadmisible en la etapa anterior.

Sin embargo, ya se sabe que la oposición tiene previsto reponer la potestad de los tribunales castrenses para las causas que involucran a uniformados, y en el Senado se requieren 26 votos para la admisibilidad: y Chile Vamos y los parlamentarios afines tienen 25.

En este escenario, la senadora y presidenta de Demócratas, Ximena Rincón, puede tener el voto decisivo, y se abre a aprobar el polémico asunto debido a la crisis de seguridad que atraviesa el país.

“Yo siempre he sostenido que tiene que haber una sola justicia para civiles y militares, y que, por tanto, la justicia militar actúe sólo en los temas propios, como los delitos militares propiamente tales. Sin perjuicio de aquello, frente a la situación que hoy día vive el país de inseguridad -mientras ello no se supere-, es recomendable dar las mayores garantías posibles a quienes actúan en el campo de la seguridad pública, y sobre todo cuando lo hacen bajo estados de excepción constitucional”, afirmó.

“En ese escenario, si esto no se aborda, por ejemplo, en la ley especial de modificación de la justicia militar, obviamente que tiene que ser abordado en Reglas de Uso de la Fuerza”, señaló la exmilitante DC.

GOBIERNO: “ES INCONSTITUCIONAL”

Desde el Gobierno, la ministra del Interior, Carolina Tohá (PPD), afirmó que “ese planteamiento en el seno del proyecto de ley de Reglas de Uso de la Fuerza no tiene asidero, porque está fuera de las ideas matrices, es una materia distinta”.

“Si alguien desea discutir eso, tendría que ser en un proyecto distinto, pero (acá) ya la Cámara de Diputados se pronunció, y no es un tema de que uno confíe que no estén los votos: es que cuando algo es inconstitucional, todos deberíamos respetar la Constitución, hasta que uno no la cambie… Uno supone que si hubo el criterio de hacer valer la Constitución en la Cámara, ese mismo criterio va a estar en el Senado”, indicó Tohá.

El martes también, finalmente, la Comisión de Defensa de la Cámara Baja revisó el proyecto que fortalece y moderniza el sistema de inteligencia del Estado.

La anterior sesión se tuvo que suspender porque no llegó ni la ministra Tohá ni el subsecretario Monsalve. Esta vez sí participaron las dos autoridades y la titular de Interior aseguró que se trata de uno de los proyectos más esperados en la agenda de seguridad, aunque todavía no parten con la votación.
