SHAH ALAM – The public is reminded to be cautious when expressing opinions or sharing information on WhatsApp to avoid making fraudulent, defamatory or seditious statements that could lead to legal action.

Senior lawyer Wan Azliana Wan Adnan said that while everyone has the right to express their opinions, they should do so in a respectful manner.

“When using social media platforms like WhatsApp, Facebook and others, ensure that the comments made are well-founded.

“It is also well understood in the constitution that we are all free to speak, but we must avoid touching on sensitivities,” she said.

Commenting on a farmer in Kepala Batas, Penang who was brought to court on Tuesday for making comments touching on racial, religious and royalty (3R) issues via a message on WhatsApp group, Wan Azliana said that everyone should learn from this case because such actions were not the first occurrence.

“Perhaps he intended to joke or be sarcastic because the conversation took place in the ‘Khariah Pmtg Sungai Dua’ group. Members of the group must also be his acquaintances.

“However, he made a mistake by making such comments, as it is clearly an offence.

“Hopefully in the future, the public will be more cautious in commenting to avoid crossing the line,” she said.

Wan Azliana said that the government should enforce the law fairly but firmly to prevent rampant defamation and sedition through social media.

“Communications Minister Fahmi Fadzil should take a firm stance against any individuals committing the same offence, regardless of who they are,” she said
