May 2 hearing for Tengku Zafrul’s affidavit in Najib’s ‘home arrest’ case

KUALA LUMPUR: The High Court will hear on Thursday Tengku Zafrul Aziz’s application to file an affidavit in a case brought by Najib Razak over a “supplementary order” purportedly issued by the former king.

Senior federal counsel Shamsul Bolhassan said the application would be heard in chambers before Justice Amarjeet Singh at 2.30pm.

Shamsul said parties were notified of the hearing date through an email from the court yesterday.

The investment, trade and industry minister is represented by law firm Cecil Abraham & Partners.

Shamsul will be appearing for the attorney-general while Shafee & Co will represent Najib.

It is unclear if the attorney-general or Najib will be opposing the application.

Last week, Tengku Zafrul said he was taking steps to “correct certain factual errors” in an affidavit filed by Umno president Ahmad Zahid Hamidi in support of Najib’s application to compel the government to produce the purported supplementary order.

Tengku Zafrul said he would be taking steps to obtain appropriate legal advice and seek leave of the High Court to file the proposed affidavit.

In his affidavit, Zahid claimed he had viewed a copy of the purported order on Tengku Zafrul’s mobile phone during a meeting at the deputy prime minister’s house.

Zahid alleged that the purported copy shown to him had been taken from the original shown to Tengku Zafrul by Al-Sultan Abdullah Sultan Ahmad Shah.

“I verily believe that for the sufficient period of time I sighted and read the addendum order, I clearly saw the entire contents and that it forms part of the pardon process of the applicant, which is supplementary to the main (royal) order both dated Jan 29.

“Thus, I hereby confirm the existence of the addendum order dated Jan 29, issued by the 16th Yang di-Pertuan Agong,” he was quoted as saying.

On Feb 2, the Federal Territories Pardons Board halved Najib’s prison sentence in his SRC International case from 12 years to six and reduced his fine from RM210 million to RM50 million.

Najib, 70, is currently serving his sentence at Kajang Prison and is to be released on Aug 23, 2028.

In his leave application filed on April 1, Najib claimed that Al-Sultan Abdullah had issued the supplementary decree during the pardon board’s meeting on Jan 29, a day before his term ended.

Najib alleged that the addendum order was not announced by the board on Feb 2 and that the government was in contempt for not executing the supplementary decree.

Amarjeet will rule on June 5 whether Najib is allowed to have the merits of his case heard.
