Home Depot has been hit with a class-action lawsuit over claims it exaggerated discounts on certain products by artificially inflating the original price.

Court documents seen by DailyMail.com include multiple examples of products including refrigerators, microwaves and dishwashers with an allegedly fake 'original price.'

Shoppers Eric Berger and Jason Londrigan, both from Texas, have now filed a case against the company in the federal court in Georgia.

They are seeking $5 million which would be shared between consumers who had been misled by the apparent discounts.

Retailers frequently come under fire for so-called 'false reference' pricing - whereby they inflate the original price to make a discount look more generous.

Berger and Londrigan tracked the advertised cost of certain products and found many had not appeared as their 'original' price in over three months.

But the lawsuit alleges the price was actually listed at its discounted price of $198 for all four weeks of November in 2023 and in the first week of December.

It then rose to $228 on the 12th and 19th December before reaching $359 by the day after Christmas.

Customers who bought it at the end of the month were therefore under the impression they were getting a good deal when in actuality the product had been around $160 cheaper just a few weeks earlier.

The product is currently available on the Home Depot website for $198 and still has the 'original price' listed as $399.

The lawsuit alleges: 'This conduct artificially increases demand for the deceptively priced products and induces customers to pay more based on a false impression of their value.

'False-reference pricing schemes thereby enable retailers like Home Depot to sell products above their true market price and value - to the detriment of consumers.'

It claims the company is in violation of both federal and Georgia state law including Georgia's Fair Business Practices Act.

Home Depot has 2,000 physical stores in North America and netted $1,53 billion in revenue in 2022.

Some 14 percent of that comes through its website, the class action states.

The court papers have only been filed, and not date has been set for a hearing. It could take months or even years before the case is settled - and payouts are made should Home Depot lose.
