Ya se encuentra en vigencia el “Reglamento sobre Análisis de Solvencia Económica e Información a los Consumidores”, que busca promover un sistema de crédito sostenible y responsable evitando el sobreendeudamiento.

Entre otras cosas, esta normativa establece que antes de otorgar un crédito, se deberá analizar la solvencia económica del consumidor, de forma en que tenga la capacidad de pago pueda cumplir con las obligaciones de la operación. Todo esto, basado en datos concretos, actuales, y obtenidos de fuentes oficiales.

Con esto, se busca evaluar la capacidad de cumplimiento del consumidor al momento de solicitar el crédito para evitar el sobreendeudamiento y contribuyendo a reducir el riesgo de que incurra en morosidad o insolvencia, analizando los ingresos del consumidor y aquellos previsibles durante el plazo de vigencia del contrato de operación de crédito, junto con el nivel de endeudamiento y morosidad actual.

También se podrá considerar la situación de empleo, el patrimonio, el ahorro, los gastos fijos, el comportamiento de pago y la existencia y calidad de garantías, entre otras condiciones objetivas que las entidades financieras deben informar públicamente. Todo lo anterior, debe hacerse respetando la privacidad del individuo y las leyes vigentes sobre protección de datos.

Las entidades deberán informar el resultado de dicho análisis, con la aceptación o rechazo de la operación de crédito de dinero.

Adicionalmente, el reglamento, señala que el análisis no debe incurrir en discriminación arbitraria, prohibiendo las prácticas que caigan en esta falta al momento de evaluar las solicitudes de créditos. Lo anterior, con el fin de que sólo factores relevantes influyan en la decisión de las entidades financieras.

“Esto quiere decir que las empresas financieras no pueden hacer, al momento de analizar la solvencia económica, distinción, exclusión o restricción que carezca de justificación razonable en el ejercicio de los derechos de las personas consumidoras, en especial cuando se funden en motivos tales como raza o etnia, orientación sexual, su identidad y expresión de género, esto más allá de lo que establece la Ley Nº 20.609 que establece medidas contra la discriminación”, explicaron desde el Servicio Nacional del Consumidor (Sernac).
