Winterthurer Polizei zum Zertifikat: «Wenn wir einen Betrieb mit violettem Kleber sehen, ist das eine Einladung zum Kontrollieren»

Einige Betriebe widersetzen sich gezielt der Zertifikatspflicht und weisen sich als «violette Zonen» aus. Das ist auch der Polizei nicht entgangen.

Seit Montag gilt in der Schweiz eine ausgeweitete Zertifikatspflicht. Wer in einem Restaurant eine Pizza essen, im Fitnesscenter schwitzen oder im Museum Kunst bestaunen will, muss sein Smartphone und einen Personalausweis zücken. Am Eingang wird so überprüft, ob man entweder geimpft, getestet oder genesen ist. Bereits im Vorfeld der Verschärfung gingen die Wogen hoch, vor allem bei Ungeimpften. Aber auch einige Wirte oder Betreiberinnen von Gym-Studios protestierten – und kündigten den Aufstand gegen die neue Regelung an.

Was ist davon geblieben? Spiegelt sich diese Entwicklung in der Zahl der Gebüssten?

Am Donnerstag zieht der Zürcher Regierungsrat und Sicherheitsdirektor Mario Fehr anlässlich einer Medienkonferenz eine erste Bilanz. Seit Anfang Woche hätten Kontrollorgane im Kanton bei insgesamt rund 600 Betrieben die Einhaltung der Zertifikatspflicht in Innenräumen kontrolliert. Daraus seien drei Verzeigungen von Betrieben an ein Statthalteramt resultiert – und zwei Gäste gebüsst worden. In der Stadt Winterthur kam es zudem bei 17 Kontrollen zu einer Verzeigung und zwei Ordnungsbussen.

Der Vollzug der Corona-Massnahmen ist im Kanton Zürich gemeinsame Aufgabe von Kanton, Städten und Gemeinden. Kontrolliert worden seien vor allem Lokale aus dem Gastgewerbe (80 Prozent der Kontrollen) sowie Sport-, Kultur- und Freizeitbetriebe (rund 20 Prozent).

Diese Kontrollen bestätigten das Bild aus den vergangenen Monaten, wonach sich Bevölkerung und Gewerbe in Zürich grösstenteils an die Bundesvorgaben hielten, sagt Fehr. Man gehe stets im Rahmen der Verhältnismässigkeit vor. Entsprechend sei in einem ersten Schritt auf einen allfälligen Missstand aufmerksam gemacht worden. Man habe den Betroffenen die Gelegenheit zur Beseitigung gegeben.

Ziel sei nicht primär die Verzeigung oder die Erhebung von Bussen, sondern die Durchsetzung der Massnahmen zum Schutz der Bevölkerung mit Augenmass, erklärt Fehr. Man wolle nicht spalten, sondern die Gesellschaft schützen. «Ich war heute selber in Fitnesscentern und Restaurants – und ich habe festgestellt: Es existiert kein abgrundtiefes Misstrauen.» Fehr zeigt sich beeindruckt, wie schnell die Massnahmen aufgenommen und umgesetzt worden seien.

Doch noch Gratistests für die nächsten Monate?

Sicher gebe es Gäste, die nicht mehr kommen wollten. «Aber es gibt auch solche, die wieder kommen, weil sie sich sicher fühlen.» Die Polizei wolle nicht büssen und drangsalieren, sondern dabei helfen, gemeinsam aus der Krise zu kommen. Fehr sagt auch: «Wahrscheinlich wäre es eine Erleichterung, wenn die Tests für die nächsten zwei bis drei Monate noch gratis wären – für all jene, die sich erst jetzt für eine Impfung entschieden haben.» Die Gesellschaft müsse zusammenhalten, müsse aber auch Verständnis haben für jene, die eine andere Meinung hätten. Das Grundziel sei es aber, den Weg aus der Pandemie zu finden.

Dem pflichtet Katrin Cometta bei. Die Vorsteherin des Departements für Sicherheit und Umwelt der Stadt Winterthur sagt während der Medienkonferenz, die neuen Regeln würden von der Bevölkerung insgesamt gut akzeptiert. «Doch Massnahmen greifen nur, wenn sie umgesetzt werden, und genau dazu braucht es Kontrollen.» Es gebe auch Fälle, in denen die Vorschriften missachten würden, wo Bussen verteilt werden müssten und dies auch zu roten Köpfen führe. «Aber es kann nicht die Aufgabe der Polizei sein, alle glücklich zu machen. Wir müssen fair, aber konsequent bleiben.»

Renitenten droht die Schliessung

Die Mehrheit der Betriebe setzt die Zertifikatspflicht also offenbar vorbildlich um. Einige widersetzen sich den Vorgaben aber gezielt. Diese weisen sich zum Teil als «violette Zonen» aus, wie die Tamedia-Zeitungen kürzlich berichteten.

Das ist auch den Behörden nicht verborgen geblieben, wie Marcel Bebié, stellvertretender Kommandant der Stadtpolizei Winterthur sagte: «Wenn wir auf einer Patrouille an einem Betrieb einen violetten Kleber sehen, ist das für uns eine Einladung zum Kontrollieren.» Oder wie es Mario Fehr sagte: «Wenn jemand explizit nach einer Busse heischt, dann kommen wir diesem Wunsch auch nach.»

Fehlbare Betriebe werden beim Statthalteramt verzeigt. Zudem wird der Fall auch dem kantonsärztlichen Dienst gemeldet. Einige Tage später folgt dann eine Nachkontrolle. Werden die Regeln weiterhin nicht eingehalten, folgt eine erneute Verzeigung. Im Wiederholungsfall kann die Gesundheitsdirektion eine Schliessung anordnen. «Und das tun wir auch, wenn sich jemand konsequent verweigert», sagte Kantonsärztin Christiane Meier.

Die Zertifikatspflicht sei ein Schlüssel zu mehr Freiheit und Sicherheit. Deren Umsetzung müsse kontrolliert werden, «das schulden wir dem erschöpften Personal in den Spitälern, den Patienten, die auf Operationen warten müssen und auch der Gesellschaft, die keine schärferen Massnahmen will».
