A wife who killed her ex-Army husband in a row over “bubble and squeak” is appealing against her conviction because she “became a meme” and didn’t get a fair trial.

Penelope Jackson, 66, was jailed at Bristol Crown Court for 18 years after she stabbed David, 78, before dialling 999 and saying “he is in the kitchen bleeding to death with any luck”.

When police officers arrived at her house in Berrow, Somerset, bodycam footage captured the moment of her arrest and this was subsequently released to the media during the trial.

The images and video also circulated widely on social media and Jackson’s lawyers claim she became “the subject of memes and dark humour”. Memes are typically images shared on social media which contain witty captions.

‘He’s an aggressive bully and I’ve had enough’

In the footage Jackson, who is wearing her pyjamas, is captured confessing “I admit it all” before going on to say “I stabbed him. He’s an aggressive bully and I have had enough.”

Audio evidence of a 999 call made by Jackson also circulated widely on social media in which she admits stabbing her husband three times following a row over serving bubble and squeak with her birthday meal.

Now, Jackson’s lawyers have revealed they are appealing her sentence on the grounds that “video and audio evidence released into the public domain midway through her trial impeded her right to a fair hearing”.

Martin Winter, Jackson’s solicitor, said: “The release of the media and the interest it stirred up created an unfairness because it coincided with the beginning of her giving evidence.

“The fear is that once the images go outside of the courtroom, the ability of the judge to advise a jury about that evidence is lost.

“Inevitably, it went further than the responsible news outlets and attracted a lot of commentary on social media.

”It was subject to mocking and mimicry and became the subject of memes and dark humour.”

Videos featuring Jackson on social media were not all negative however, and some even praised her actions, with one person commenting: “Is this woman anyone else’s spirit animal? I want her autograph.”

Jackson admitted killing her husband but denied murder, claiming instead she suffered a “loss of control” after decades of emotional and physical abuse at the hands of the former army lieutenant colonel.
