Just weeks after India got its first tribal woman president and on the day Prime Minister Narendra Modi spoke about women’s empowerment in his Independence Day address, Bilkis Bano got the news that the men who had gang-raped her and murdered seven members of her family, including her three-year-old daughter, during the 2002 communal riots in Gujarat had walked out of prison—released by the Gujarat government under its remission policy.

Bilkis was 20 years old and several months pregnant at the time she was subjected to the brutality by men she had apparently known for years. She referred to one of them as ‘Chacha’ (uncle) and others as brothers. She was gang-raped and left almost lifeless. She saw her family members being killed. On regaining consciousness, Bilkis borrowed clothes from a tribal woman and went to the Limkheda police station in Dahod district to register a complaint. The head constable there suppressed facts and wrote a truncated version of the complaint. In her statement, Bilkis had said: “I found myself naked. I saw bodies of my family members lying around. I got frightened. I looked around for some cloth to cover myself. I found my petticoat and covered my body and proceeded into the interiors of the hills nearby.”

It was just the beginning of her ordeal in pursuit of justice. She received death threats, prompting the Supreme Court, in 2004, to move the trial out of Gujarat to Mumbai. Yet she persevered. In January 2008, a special CBI court in Mumbai convicted 11 of the 20 accused on charges of conspiracy to rape a pregnant woman, murder, unlawful assembly, and other charges under various sections of the Indian Penal Code. The head constable was convicted for “making incorrect records” to save the accused. Seven of the 20 accused were acquitted due to lack of evidence. One person died during the course of the trial.

This August 15, the 75th anniversary of India’s independence, all 11 convicts in the case walked free, namely Jaswantbhai Nai, Govindbhai Nai, Shailesh Bhatt, Radhyesham Shah, Bipin Chandra Joshi, Kesarbhai Vohania, Pradeep Mordhiya, Bakabhai Vohania, Rajubhai Soni, Mitesh Bhatt and Ramesh Chandana.

The travesty of justice runs across many layers. Given the systemic oppression and distortion of facts, it took Bilkis years to get some sort of closure. In 2019, the Supreme Court ordered the Gujarat government to pay Bilkis Rs 50 lakh as compensation. However, she hasn’t had a permanent address all these years. Bilkis has moved 20 homes as she has constantly faced threats to her life and persecution by society.

One of the convicts, Radheshyam Shah, had approached the Gujarat High Court for remission of his sentence. The HC dismissed his plea while observing that the “appropriate government” to decide on his remission was Maharashtra and not Gujarat. Shah filed a plea in the Supreme Court, pleading that he had been in jail for over 15 years without remission as of April 1, 2022. In its May 13 order, the top court stated that since the crime was committed in Gujarat, the government of the state was most appropriate to examine the application.

The government of Gujarat set up a committee, which took a unanimous decision for remission. “The committee took a unanimous decision in favour of remission of all 11 convicts. The recommendation was sent to the state government and we received orders for their release,” Sujal Mayatra, head of the committee and Panchmahal collector, told news agency PTI.

Earlier, in July, the Centre had issued guidelines to states on the release policy for prisoners coinciding with Independence Day. However, the policy is clear that rape convicts and those convicted for life are ineligible. So, did the Gujarat government violate the central guideline by releasing the convicts in the Bilkis Bano case?

Noted lawyer and human rights activist Vrinda Grover, while speaking to India Today TV, termed the Gujarat government’s step as a “travesty and grave miscarriage of justice”. She said that under Section 435 of the Code of Criminal Procedure, in cases investigated by the CBI, powers shall not be exercised by the state government without consultation with the central government. “This remission couldn’t have happened without mandatory consultation with the Centre, which is the ministry of home affairs,” Grover said.

Ironically, the release of the convicts has happened as per an old (1992) remission policy of Gujarat. The policy is not available for public view. The state’s remission policy was revised in 1994 and bars early release of those convicted of heinous crimes like rape and murder.

No doubt the remission of rape and murder convicts shows India in very poor light. To many, it’s a messaging from the state that such heinous crimes are pardonable. Yakoob Rasool, husband of Bilkis, has told the media that his family had not been consulted on the remission for the convicts. He also said that the family was waiting for the house and job to be given by the Gujarat government as per the Supreme Court’s orders.

Bilkis is an inspiration because she showed rare courage in pursuing her fight for justice against extreme odds. The justice she had sought and achieved now stands torn to shreds, throwing a question at us: While India witnessed a massive outcry for Nirbhaya’s rapists to be hanged, why the muted public reaction to remission for Bilkis Bano’s rapists?
