If released on bail, Jet founder's health may worsen, says court

MUMBAI: In a detailed order rejecting the bail sought on medical grounds by Jet Airways founder Naresh Goyal, a special PMLA court reasoned that once he is discharged to enjoy liberty of his bail, there is every chance of his health deteriorating and getting affected by infections.

The judge said that Goyal needed prolonged hospitalisation and a personal attendant due to his infirmities, and the same had already been granted. “There will be no change in this circumstance even if he is released on bail. On the contrary, his present treatment and hospitalisation are equivalent to bail on medical grounds because there is no one in his family to look after him, as his wife is also hospitalised in the same hospital,” special judge MG Deshpande said.

The judge also said that none of his treating doctors had either opined that bail would reform his health or that his judicial custody is a barrier in his treatment. Regarding other grounds, such as his age being 75 years and his wife Anita Goyal diagnosed with a recurrence of cancer, the judge said that his release will be of no help for her, particularly when the same hospital has admitted her. “On the contrary, it would be an added inconvenience,” the judge said.

While Goyal’s lawyers submitted that he was depressed and expresses a dread of the future, suicidal ideation and a sense of hopeless resignation, the judge said that his hospitalisation aided by the advice of doctor itself is the best remedy to overcome this psychiatric issues.
