Trotz Subventionsaffäre: Die ehemaligen Topkader des Bahnunternehmens BLS können ihre Boni behalten. Das Unternehmen sieht keine Handhabe, vertraglich zugesicherte variable Vergütungen rückwirkend einzufordern, bestätigte die BLS eine Meldung in der «Berner Zeitung» und im «Bund» vom Mittwoch auf Anfrage.

Das Bahnunternehmen BLS steht in der Kritik, jahrelang zu hohe Subventionen vom Bund bezogen haben. Die Rede ist von über 70 Millionen Franken. Damit hätten sich auch die Finanzziele einfacher erreichen lassen, von denen die Boni der Topkader zu einem Teil abhängig waren.

BLS-Chef Guillelmon erhielt 100’000 Franken

Zuletzt machten die Finanzziele noch rund 17 Prozent der variablen Lohnbestandteile aus. Die restlichen Bestandteile waren qualitative Ziele wie etwa die Entwicklung von Geschäftsmodellen oder die Führung von Mitarbeitenden.

Insgesamt erhielt BLS-Chef Bernhard Guillelmon seit 2012 rund 100’000 Franken pro Jahr, die Geschäftsleitungsmitglieder im Schnitt etwa die Hälfte. Der Berner Verkehrsdirektor Christoph Neuhaus hatte gefordert, die BLS solle prüfen, ob sie bei den damaligen Managern um Bahnchef Bernard Guillelmon Boni zurückfordern könne, sofern diese aufgrund der zu hohen Subventionen erzielt worden seien.

Chefs wussten seit 2017 über Bschiss Bescheid

Bei der BLS wusste die Geschäftsleitung laut einem Untersuchungsbericht des Wirtschaftsprüfers PWC seit spätestens März 2017 von den zu viel bezogenen Bundesgeldern. Die Abteilung Preissysteme soll dies bereits seit 2012 gewusst haben. Guillelmon handelte erst 2019 auf Druck des Kantons. Gekürzt wurden die Boni erst nach Auffliegen des Subventionsskandals. Guillelmon trat 2020 ab und auch die meisten damaligen Geschäftsleitungsmitglieder sind nicht mehr an Bord.

«Ab 2021 sind in den variablen Lohnanteilen keine Finanzziele mehr enthalten. Wir haben erkannt, dass solche Finanzziele unter Umständen falsche Anreize schaffen und haben die Praxis deshalb korrigiert», schreibt die BLS in ihrer Mitteilung.

Experte zieht Entscheid in Zweifel

Peter V. Kunz, Professor für Wirtschaftsrecht an der Universität Bern, zeigt sich in «Berner Zeitung» und «Bund» am Mittwoch erstaunt, dass die BLS die Managerboni nicht zurückfordern will. Juristisch sei es zwar richtig, dass eine Rückforderung nicht ohne weiteres möglich sei. Doch generell ausgeschlossen sei dies nicht.

Kunz denkt da beispielsweise an eine gerichtliche Anfechtung, die auf dem Tatbestand der Täuschung basiert. Andererseits könnten solche Klagen mindestens angedroht werden, um in der Folge auf Verhandlungsebene eine freiwillige Rückzahlung zu erreichen.

Rechtlich ist die Subventionsaffäre für die BLS noch nicht ausgestanden. Das Bundesamt für Verkehr hat Strafanzeige eingereicht. Sie ist derzeit beim Bundesstrafgericht hängig. (SDA/sf)
