La mañana de este domingo, el subsecretario del Interior, Manuel Monsalve, anunció que el gobierno ingresará una querella contra quienes resulten responsables del asesinato de los tres uniformados que fueron hallados al interior de un vehículo calcinado en Cañete, Región del Biobío.

Tras una reunión con la fiscal a cargo de las indagatorias, Marcela Cartagena, y la delegada presidencial de la Región del Biobío, Daniela Dresdner, el subsecretario indicó que se querellarán por homicidio contra Carabineros, infracción a la Ley de Armas, organización criminal, incendio y robo con violencia e intimidación.

Pese a que el Presidente Gabriel Boric, calificó el crimen como un atentado terrorista, la acción judicial no contempla la Ley Antiterrorista.

Monsalve explicó que a “nosotros nos gustaría presentar una querella bajo la Ley Antiterrorista, pero no permitiría ser lo suficientemente eficaces en la investigación y tampoco permitiría aplicar las penas más altas”.

Cerca de las 13.00 horas, la ministra del Interior, Carolina Tohá, confirmó que ya habían sido ingresadas la querellas. Además, insistió que no se invocó la Ley Antiterrorista porque “la experiencia nos ha mostrado que esa ley no funciona. Cuando actuamos con esa norma no se obtienen condenas, ni siquiera formalizaciones, y por eso la estamos tratando de cambiar.

“El gobierno tiene un proyecto presentado, que ya se aprobó en la Comisión de Constitución, y sería bueno que se acelerara esta etapa, porque sin duda necesitamos una Ley Antiterrorista que podamos usar en casos como este”.

En cambio, con las acciones judiciales que presentaron, la titular de la cartera recalcó que “tienen las penas más altas y llegarían hasta los 50 años, que es lo más alto que contempla el ordenamiento jurídico chileno”.
