Tiada keterangan menunjukkan kesalahan Zahid, mahkamah diberitahu

KUALA LUMPUR: Peguam mewakili Ahmad Zahidi Hamidi menyifatkan kes rasuah bekas timbalan perdana menteri itu sebagai “pelik” kerana tidak ada keterangan secara langsung yang dikemukakan di mahkamah bagi menunjukkan kesalahannya.

Hisyam Teh Poh Teik ketika menutup kes pembelaan memberitahu hakim Mahkamah Tinggi Collin Lawrence Sequerah bahawa saksi penting dalam lapan kes rasuah membabitkan Zahid, iaitu Junaith Asharab Md Shariff, Abu Hanifah Noordin, Chew Ben Ben dan Azlan Shah Jaffril memberitahu mahkamah semua wang yang diberikan kepada Yayasan Akalbudi adalah sumbangan.

“Ia adalah jelas bahawa mereka tahu wang terbabit adalah sumbangan untuk tujuan kebajikan atau politik.

“Mereka menegaskan bayaran itu bukan untuk tujuan tukaran kontrak kerajaan.

“Kami mendapati ia agak pelik mengapa dakwaan ini dikemukakan, melainkan pendakwaan boleh menyebut undang-undang kes yang mempunyai fakta yang hampir sama…iaitu seseorang didakwa kerana rasuah dengan saksi-saksi mengatakan wang itu bukanlah satu bentuk ‘rasuah’,” katanya.

Hisyam menegaskan bahawa sumbangan itu tidak menyalahi undang-undang walaupun selepas Sequerah menyatakan bahawa sumbangan politik disenaraikan sebagai bentuk rasuah di bawah Akta Suruhanjaya Pencegahan Rasuah Malaysia (SPRM).

“Pihak pendakwaan mesti membuktikan alasan mengapa bayaran itu dibuat, sama ada tidak salah atau sebaliknya,” kata Hisyam.

Zahid dibicarakan atas 47 pertuduhan pengubahan wang haram dan pecah amanah jenayah (CBT) membabitkan jutaan ringgit dana milik Yayasan Akalbudi dan menerima rasuah untuk pelbagai projek ketika menjadi menteri dalam negeri.

Sebanyak 12 daripada dakwaan itu membabitkan CBT, lapan kes rasuah manakala selebihnya adalah pengubahan wang haram.

Sequerah kemudian berkata, pendakwaan mengambil keputusan bahawa fakta dalam kes Zahid menunjukkan kontrak kerajaan diberikan kepada beberapa syarikat dan kemudian wang dikatakan dibayar kepada tertuduh sebagai ganjaran.

Sequerah: Bolehkah kesimpulan dibuat berdasarkan fakta?

Hisyam: Apabila terdapat keterangan secara langsung daripada saksi-saksi (mengenai tujuan pembayaran), mahkamah tidak boleh membuat kesimpulan mengenai mengapa wang itu dibayar.

Terdahulu, Hisyam memberitahu mahkamah bahawa RM2 juta daripada Pengarah Profound Radiance Sdn Bhd, Azlan Shah adalah untuk kebajikan dan syarikat itu beroperasi sebagai pusat sehenti untuk memproses permit kerja bagi pekerja warga Pakistan dan Nepal.

Katanya, cek syarikat itu menyebut pembayaran yang dibuat melalui tiga keping cek sebagai “dana politik” dan amal”.

Pendengaran bersambung esok dengan Timbalan Pendakwa Raya Raja Rozela Raja Toran memulakan hujahnya.
