The Supreme Court on Monday deferred the hearing on Shiv Sena (Uddhav Bal Thackeray) petition challenging Maharashtra Assembly Speaker Rahul Narwekar’s decision recognising Chief Minister Eknath Shinde-led faction as the “real Shiv Sena” and rejecting petitions seeking disqualification of MLAs siding with him.

A three-judge bench presided by CJI D Y Chandrachud, before whom it was listed Monday, however, could not take it up due to shortage of time. As the bench was about to rise at the end of the day’s proceedings, Senior Advocate Kapil Sibal appearing for Shiv Sena (UBT) raised the issue and pointed out that the matter is pending.

The bench, also comprising Justices J B Pardiwala and Manoj Misra, said it had some time-taking matters on Monday and agreed to hear the Sena (UBT) plea on an early date.

Opposing the plea, Senior Advocate Harish Salve said that the Shinde group had already approached the Bombay HC, which is seized of the matter.

The CJI said the court will first hear the question of maintainability, to which Sibal pointed out that the court had already issued notice in the matter. The SC had on January 22 issued notice on the petition.

Calling the Speaker’s order “unlawful and perverse”, the Shiv Sena (UBT) sought a stay on it, and relief to restrain the Shinde faction from issuing any directions to Shiv Sena (UBT) MLAs to avoid being forced to follow Bharat Gogawale (Shinde faction), whom the Speaker recognised as the chief whip.
