Tirsdag faldt der dom i en opsigtsvækkende sag.

En lejer var nemlig blevet smidt ud af sin lejlighed, fordi hendes ældste søn støjede for meget for de andre beboere.

Kvinden valgte imidlertid at bringe sagen for boligretten, fordi hun ønskede, at retten skulle tage stilling til, om opsigelsen var berettiget.

Infantil autist

Kvinden flyttede ind i det omtalte lejemål i februar 2022 med sine to børn, men allerede efter få måneder fik udlejeren de første klager fra andre beboere.

Den ældste af kvindens børn er nemlig infantil autist og har ikke noget verbalt sprog. Det betød, at barnet støjede med voldsomme skrig, råb og højlydt banken.

Moderen havde eftersigende gjort alt, hun kunne, for at mindske barnets adfærd, men de mange klager betød, at kvinden og hendes børn blev smidt ud af lejligheden i starten af marts 2023.

En opsigelse, der var berettiget, ifølge retten i Lyngby.

Helt urimelig grad

I domsesuméet skriver retten, at den støj, der kom fra den autistiske søn, var af et så betydeligt omfang, både hvad angår lydstyrke og hyppighed, at det var langt ud over, hvad man kunne forvente af støj fra et barn.

Retten anerkender dog, at moderen havde gjort, hvad hun kunne for at mindske støjen, men det ændrede ikke på, at situationen var af en sådan karakter, at det var urimeligt overfor de andre beboere.

Kort sagt nåede retten altså frem til, at opsigelsen fra udlejerens side var gyldig.
