Seine ehemalige Affäre holt Bundesrat Alain Berset erneut ein

Trotz einer Stillschweigevereinbarung, die der Gesundheitsminister mit einer ehemaligen Geliebten abgeschlossen hat, zitiert die «Weltwoche» ausführlich aus den Akten des Strafverfahrens. Das Leak dürfte aber wohl woanders liegen.

Im vergangenen November machte die «Weltwoche» publik, dass eine ehemalige Geliebte von Bundesrat Alain Berset versucht hatte, den Gesundheitsminister zu erpressen. Die Frau, eine Künstlerin Anfang dreissig, war deswegen im September 2020 per Strafbefehl wegen versuchter Erpressung rechtskräftig zu einer bedingten Geldstrafe verurteilt worden. Der Strafbefehl konnte von den Medien eingesehen werden, war aber an den entscheidenden Stellen geschwärzt. Womit die frühere Geliebte Berset erpresst hatte, ging daraus nicht hervor.

Jetzt hat die «Weltwoche» dieses Rätsel gelöst. Mit Verweis auf die Strafakten heisst es, die Frau habe dem Bundesrat Ende 2019 gedroht, bekanntzumachen, dass er sie einst genötigt habe, eine Abtreibung vorzunehmen. Falls er ihr nicht wie versprochen 100 000 Franken überweise, werde sie damit an die Öffentlichkeit gehen. Die Beziehung hatte rund acht Monate gedauert, von Frühling 2012 bis Anfang 2013. Bis 2017 blieben die beiden in gelegentlichem SMS-Kontakt.

Die versuchte Erpressung erfolgte zu einem heiklen Zeitpunkt, wenig später standen die Gesamterneuerungswahlen des Bundesrats an. Berset, Vorsteher des jüngst stark beanspruchten Gesundheitsdepartements, stieg aber nicht darauf ein, sondern schaltete stattdessen die Bundesanwaltschaft ein, wo er Anzeige erstattete.

Von der Abtreibung zur «Pille danach»

Wie ebenfalls aus dem Bericht der «Weltwoche» hervorgeht, krebste die ehemalige Geliebte im Laufe des Strafverfahrens schrittweise zurück. Zunächst räumte sie ein, Berset habe nichts von einer Abtreibung gewusst und sie folglich auch nicht dazu genötigt. Zuletzt, in einer aussergerichtlichen Vereinbarung, gestand sie sogar ein, gar nie von Berset schwanger gewesen zu sein.

Was nicht in der «Weltwoche» steht: Polizeiliche Ermittlungen legen offenbar den Schluss nahe, dass es sich bei der angeblichen Abtreibung um die Einnahme einer sogenannten Pille danach gehandelt haben dürfte – allerdings mehrere Monate nach Beendigung der Beziehung mit Berset, also im Zusammenhang mit einem anderen Partner. Die Konfrontation mit diesen Fakten soll die Künstlerin dazu bewogen haben, die schriftliche Vereinbarung mit Berset zu unterzeichnen.

Darin wird sie, jetzt wieder gemäss «Weltwoche», zu Stillschweigen verpflichtet sowie zu einem Kontaktverbot mit der Familie Berset. Auch muss sie alle Dokumente aus der ausserehelichen Beziehung mit dem Gesundheitsminister unwiderruflich löschen. Im Gegenzug hat ihr Berset in Aussicht gestellt, sämtliche Kosten zu erlassen, die sie ihm aufgrund der strafrechtlichen Verurteilung schuldet, insbesondere das Anwaltshonorar in Höhe von 34 000 Franken. Dieses wird angeblich von Berset persönlich bezahlt, sein Rechtsvertreter jedenfalls ist privat mandatiert.

Polizeieinsatz in Zivil

Verschiedene Umstände sprechen dagegen, dass die frühere Geliebte ihre Stillschweigevereinbarung gebrochen und damit eine Konventionalstrafe von 20 000 Franken in Kauf genommen hat. Weil zudem Angaben zum Einsatz der polizeilichen Sondereinheit «Tigris» nicht in den Parteiakten enthalten sind, ist eher davon auszugehen, dass die Dokumente via Bundesbehörden der «Weltwoche» zugespielt worden sind – infrage kommen die Bundesanwaltschaft oder die Bundespolizei (Fedpol).

Ausführlich wird in der «Weltwoche» der Einsatz der polizeilichen Sondereinheit «Tigris» geschildert. Laut Auskunft von Cathy Maret, der Kommunikationschefin von Fedpol, habe es sich bei der sogenannten Anhaltung der betroffenen Frau – am 13. Dezember 2019 in der Nähe ihres Wohnortes im Kanton Zürich – um einen Standardeinsatz gehandelt. Die Angehörigen der genannten Sondereinheit waren in Zivil vor Ort und hielten sich im Hintergrund auf. Zwei ordentliche Ermittler der Bundespolizei, unter ihnen eine Frau, hätten die Tatverdächtige ebenfalls in Zivil angesprochen. Den Transport in die Zentrale nach Bern habe schliesslich wie üblich die Sondereinheit übernommen. Gemäss Strafbefehl befand sich die Inhaftierte während knapp acht Stunden in Polizeihaft.

Nach dem Bekanntwerden der Affäre im vergangenen November hat die Aufsichtsbehörde AB-BA angekündigt, bei der Bundesanwaltschaft aufsichtsrechtliche Abklärungen einzuleiten, um deren Verhalten im politisch heiklen Umfeld zu prüfen. Laut Auskunft von Ständerat Hans Stöckli liegt der Bericht der AB-BA seit wenigen Tagen den Subkommissionen Gerichte/Bundesanwaltschaft vor. Er soll an der nächsten Sitzung Ende Oktober behandelt und anschliessend allenfalls dazu kommuniziert werden. Vom Aufsichtsbericht nicht betroffen ist allerdings der Einsatz der Bundespolizei beziehungsweise ihrer Sondereinheit «Tigris».

Wie der Zürcher SVP-Nationalrat Alfred Heer am Donnerstag gegenüber CH Media ankündigte, will er an dieser Sitzung den Antrag stellen, die Vorgänge in Bersets Departement zu untersuchen. Insbesondere wolle er geklärt haben, ob es richtig ist, wenn ein Bundesrat seinen Generalsekretär damit beauftragt, private Probleme zu lösen.

Anhand des jetzigen Wissensstands wird die Affäre für Alain Berset aber vermutlich keine politischen Konsequenzen haben – zumindest solange kein strafrechtlich relevantes Vergehen bekannt wird. Einzig wegen des Auffliegens einer ausserehelichen Beziehung ist ein Bundesrat kaum angreifbar. Affären von Entscheidungsträgern im Bundeshaus gelten weitgehend als Privatsache. Sie werden selbst dann nicht publik gemacht, wenn sie einem breiten Kreis bekannt sind.
