Tripura high Court will examine the matter of clamping section 144 of CrPC in East Agartala and West Agartala Police Station areas on October 5. The court has served notices as the district administration has clamped 144 for nearly 45 days.
The petitioner has challenged an order, dated 20th September 2021, passed by the District Magistrate, West Tripura, prohibiting any kind of meeting/procession/public gathering by any political party in Sadar Police Sub Division (East Agartala and West Agartala Police Station areas) (from 6:00 A.M 21st September 2021 to midnight 4th November 2021) in exercise of powers under Section 144 of Cr.P.C.
Counsel for the petitioner submitted that the impugned order is passed without proper application of mind, without sufficient material available with the authority to form a belief that the situation is so emergent that such a blanket prohibition should be imposed for two weeks, thereby suspending all political activities in the area.
He submitted that the authority has not considered the choice of least invasive restriction. The division bench of Chief Justice AA Kureshi and Justice SG Chattopadhyay stated, “We would like to examine the issues for which purpose let there be a notice, returnable for 5 th October 2021.”
Earlier the district administration has twice denied permission for a mega rally to be led by Trinamool Congress’s national General Secretary Abhishek Banerjee in Agartala. The party has applied for permission for holding a rally in Agartala on September 15 which was denied citing that permission was already given to a political party to hold a rally in the same route.
Bjp’s women wing has planned a rally and permission was accorded to this rally. After this TMC applied for another date and planned to hold a rally on September 16.
Sub-Divisional Police Officer-Sadar Anirban Das in a letter to Trinamool leader Subal Bhowmik said that it is not possible to permit for holding of rally on September 16 since there will be law and order commitment of Police in view of Viswakarma Puja which falls on September 17.
