founder Rana Kapoor’s wife Bindu Kapoor and daughters Roshini and Radha Kapoor Khanna on Monday approached the Bombay High Court seeking bail in a corruption case involving housing finance company DHFL.

The court refused to give any immediate reliefs and posted the matter for hearing on Wednesday, a lawyer connected with the case said.

The Kapoors, in three identical but separate bail pleas, challenged a special Central Bureau of Investigation (CBI) court order on Saturday that rejected their bail pleas and remanded them to judicial custody.

They argued that they have extended the fullest support to the CBI during the course of an investigation into a Yes Bank-DHFL quid pro quo case registered last year.

“The interest of the investigation agencies stand protected as the Enforcement Directorate (ED) has attached properties and bank accounts of the applicant to the tune of Rs 600 crore under various provisional attachment orders,” argued the petition filed by Radha Kapoor Khanna.

As per the CBI, Rana Kapoor and his family members had allegedly received kickbacks of around Rs 600 crore for an investment of Rs 3,700 crore made by Yes Bank in DHFL’s debentures.

“Special Judge failed to consider that the applicant has been granted bail in the PMLA case arising out of the current FIR in the same facts and circumstances,” Khanna’s petition said. “The factual matrix of the case is identical and the applicant was not arrested during the course of investigation, complaint was filed, cognisance was taken by the honourable court, summons were issued to the applicant pursuant to which the applicant appeared before the honourable court and was granted bail.”

Bindu Kapoor’s petition claimed that “the applicant is entitled to a lenient view in the matter of bail because she is a woman”.

Advocate Hiten Venegaonkar, appearing for ED, informed the court that the Kapoors are currently in the Byculla women’s prison where the jailor accepted their custody after RT-PCR tests showed they don’t have Covid-19.

The special court, while rejecting their bail petitions, had observed that the trio are involved in the wrongful loss of public money to the tune of Rs 4,000 crore, which belongs to the public at large, including bank depositors and shareholders.

In a related development, a special CBI court denied bail to Rajiv Anand, the then group president and business head of YES Bank and remanded him to judicial custody. While, other two accused who were recently charge-sheeted by the CBI, chartered accountant, Dulresh Jain and valuer Sunil Chaudhary have been granted bail by the special court.
