PERNIAGAAN berkonsepkan multi level marketing (MLM) atau jualan langsung sebenarnya sudah tidak asing lagi di negara ini.

Sejak awal lagi masyarakat didedahkan konsep perniagaan jualan langsung yang mempromosikan pelbagai produk daripada kegunaan harian sehinggalah produk kesihatan.

Dengan barisan produk yang hebat, berkualiti dan menggunakan teknologi moden selain menawarkan angka komisen yang tertinggi menarik minat ramai pengguna membeli produk ditawarkan malah menjadi agen syarikat.

Industri jualan langsung juga antara bentuk perniagaan yang menyumbang kepada pendapatan individu dan ekonomi negara.

Perniagaan dalam kategori ini memberi ruang dan peluang kepada orang ramai untuk menambah pendapatan isi rumah khususnya pada masa kini yang terbeban dengan kos sara hidup tinggi akibat inflasi dan ketidaktentuan geopolitik dan ekonomi global.

Industri ini titik permulaan bagi individu yang mahu menjana sumber mata pencarian secara tetap atau sampingan ke arah meningkatkan taraf hidup ke arah lebih baik.

Persepsi

Memandangkan sambutan hangat dan menggalakkan pengguna dan masyarakat amnya, syarikat ini muncul bak cendawan tumbuh selepas hujan.

Masyarakat acap kali kelabu mata dengan penampilan hebat pemimpin yang memakai sut berjenama, kenderaan mewah dan sebagainya.

Gambaran inilah yang menyebabkan masyarakat kerap kali tertipu dan menganggap dengan menyertai industri ini mereka akan mudah menjadi kaya dengan pantas tanpa perlu berusaha gigih.

Salahnya di sini ialah pemimpin atau ahli syarikat ini seringkali terlebih janji kepada bakal ahli mereka. Apabila sistem itu melencong dan digunakan oleh mereka yang tamak haloba demi menguntungkan mereka dari peringkat atasan hinggalah ke bawah.

Ketaasuban ahli menyebabkan mereka masing-masing menolak segala pandangan orang yang lebih arif dan pakar dalam industri, pakar kewangan serta tokoh-tokoh agama.

Syarikat, peruntukan perundangan dan hukum syarak

Syarikat tempatan dan luar negara berkonsepkan jualan langsung ini bersaing hebat mendapatkan pelanggan dan antaranya menawarkan produk tidak masuk akal dan kadar komisen mampu menggugat iman.

Apabila munculnya produk yang tidak masuk akal keberkesanannya dan pelan pemasaran yang sentiasa berubah-ubah menyebabkan pihak kerajaan Persekutuan menggubal akta iaitu Akta Jualan Langsung Dan Skim Anti-Piramid 1993.

Jelas, akta ini digubal bagi mengawal selia industri jualan langsung sekali gus melindungi hak pengguna di negara ini daripada dianiaya daripada pihak tidak bertanggungjawab.

Walaupun dengan adanya peruntukan perundangan, namun ia masih mempunyai sisi buta apabila ia sering dimanipulasikan oleh syarikat jualan langsung ini.

Sememangnya syarikat itu berlesen dan mematuhi perundangan sedia ada, namun ia dimanipulasikan apabila sesebuah syarikat itu mendapat lesen mereka.

Antaranya, manipulasi sistem seperti pelan pemasaran yang sentiasa berubah, pemberian komisyen tidak adil, pembelian stok dan kenaan harga pakej tidak masuk akal serta yuran keahlian tinggi.

Walaupun dengan adanya rungutan dan aduan yang dilaporkan kepada pihak berkuasa namun kelewatan pihak berkenaan mengambil tindakan tegas menyebabkan lebih ramai ahli tertipu dan mengalami kerugian jutaan ringgit.

Hukum syarak

Dari sisi dan perspektif hukum syarak pula, pihak berautoriti agama menerusi Muzakarah Jawatankuasa Fatwa Majlis Kebangsaan Bagi Hal Ehwal Ugama Islam Malaysia Kali Ke-72 yang bersidang pada 25-26 Februari 2006 memutuskan bahawa: Konsep, struktur dan undang-undang perniagaan MLM yang diluluskan Kerajaan adalah harus dan tidak bercanggah dengan konsep perniagaan Islam.

Keputusan yang dibuat ini melegakan ramai pihak khususnya syarikat jualan langsung tempatan yang secara jujurnya bergerak dalam industri.

Meskipun begitu, kini penggunaan patuh syariah semakin popular. Label patuh syariah ini seakan-akan satu label yang wajib seperti sijil Halal yang dikelolakan oleh Jabatan Kemajuan Islam Malaysia (Jakim).

Tiada patuh syariah maka pelbagai hukum dilemparkan kepada syarikat antaranya dilabelkan songsang, anti Islam, tidak bermanfaat dan sebagainya.

Realitinya perkara ini berlaku dan tidak terkecuali ada syarikat luar negara yang turut terkena tempiasnya.

Syarikat ini dahulunya menarik ramai minat masyarakat Melayu Islam di negara ini khususnya.

Sambutan hangat dan menggalakkan daripada masyarakat terhadap sistem dan pelan pemasaran yang mudah diterima, harga produk berpatutan dan berkualiti tinggi serta meraih sijil halal bagi setiap produk keluarannya antara faktor mengapa masyarakat mudah menerimanya.

Ramai antara ahlinya penjawat awam seperti guru, polis, jururawat dan sebagainya malah ada juga mereka yang tidak bekerja tetap seperti golongan remaja, freelancer, suri rumah dan pesara.

Tambahan pula ramai ahli yang berjaya dalam syarikat ini yang dahulunya penerima zakat kini menjadi pembayar zakat dan mampu menyumbang kepada kepada masyarakat memerlukan.

Namun, ada yang tidak berpuas hati dan ini ternyata berlaku di kalangan syarikat pesaing terutamanya dari kalangan syarikat tempatan itu sendiri.

Akibatnya, syarikat berkenaan diserang dengan hebat dan pelbagai faktor dilemparkan antaranya ialah syarikat itu tiada patuh syariah dan menyokong gerakan agama.

Kononnya syarikat ini menyokong dakwah agama selain Islam dan memurtadkan Muslim di dalam dan luar negara.

Syarikat ini juga dituduh menyumbangkan wang dan bantuan kepada organisasi terbabit seperti rumah anak yatim, pusat jagaan warga emas dan sebagainya.

Alasan dan tohmahan yang dilemparkan ini dilakukan secara bertubi-tubi tanpa henti dan menyebabkan ramai ahli berbangsa Melayu dan beragama Islam keluar dari syarikat.

Pihak berkuasa tempatan, pihak berautoriti agama pun mula popular apabila ramai ahli syarikat itu membuat laporan kononnya syarikat ini menyokong agama berkenaan dan menyebarnya di dalam dan luar negara.

Patuh syariah

Walaupun keputusan muzakarah pada Februari 2006 memutuskan: Konsep, struktur dan undang-undang perniagaan MLM yang diluluskan Kerajaan adalah harus dan tidak bercanggah dengan konsep perniagaan Islam, namun ia adalah satu keperluan bagi sebuah syarikat untuk mendapat keyakinan dan kepercayaan pengguna Muslim dengan memperoleh sijil pematuhan syariah.

Dalam konteks ini, akhbar ingin memetik kenyataan seorang ilmuwan Islam, tokoh akademik dan juga penasihat syariah di banyak syarikat terkemuka dalam dan luar negara iaitu Profesor Emeritus Datuk Paduka Dr Haji Mahmood Zuhdi Haji Abdul Majid.

Beliau yang mempunyai pengalaman luas dalam bidang syariah dan muamalah Islam juga merupakan Pengerusi Majlis Dakwah Negara dan beliau pernah menggalas beberapa jawatan penting di dalam kerajaan antaranya AJK Fatwa Negeri Kelantan (1990-2012), Panel Hakim Mahkamah Rayuan Syariah Negeri Kelantan (1990-2012), Ahli Lembaga Dewan Bahasa dan Pustaka (DBP) (2006-2012), Ahli Lembaga Pemegang Amanah Yayasan Pembangunan Ekonomi Islam Malaysia (Yapeim) (2004-2013), Pesuruhjaya Hak Asasi Manusia Malaysia (Suhakam) (2010-2016) dan Pengerusi Majlis Dekan Pengajian Islam Malaysia (2012-2014).

Kini beliau menerajui dan menganggotai Lembaga Penasihat Syariah Atomy Malaysia Sdn Bhd iaitu sebuah syarikat jualan langsung yang dikritik dan diserang hebat oleh masyarakat tahun lalu.

Ketika diberi tanggungjawab menggalas jawatan itu, beliau memaklumkan bahawa ia merupakan peranan penting yang harus dipikul dalam mendidik masyarakat Islam itu sendiri.

Setelah mengambil masa selama setahun dalam menyelidiki dan membuat kajian secara total tentang struktur, hal ehwal kewangan syarikat, elemen sistem pengoperasian patuh syariah dalam bermuamalat serta tidak dibiarkan juga kajian mendalam terhadap isu sentimen agama yang menyelubungi Atomy

Malaysia dan syarikat induknya, beliau bersama rakan penasihat syariah lain mengisytiharkan syarikat itu kini patuh syariah.

Menurut beliau, keputusan itu diambil selepas menyedari syarikat itu menepati peruntukan parameter syariah yang ditetapkan Jakim selain beberapa siri auditan serta saringan ketat yang merangkumi aspek kewangan, operasi, pentadbiran, pelan pemasaran dan juga aktiviti tanggungjawab sosial korporat syarikat.

Beliau berkata, meskipun pada mulanya banyak kekurangan dalam mengimplementasi aspek muamalah dan keperluan syariah dalam syarikat berkenaan, namun ianya telah dapat diatasi secara berperingkat.

“Kelancaran proses amat berkait rapat dengan sikap keterbukaan pengurusan syarikat induk selain kerjasama erat dan ampuh yang diberikan oleh semua pihak termasuklah presiden syarikat itu sendiri tanpa melindungi apa-apa kepentingan mahupun menyembunyikan agenda peribadi masing-masing,” katanya.

Beliau berharap dengan sumbangan yang sedikit darinya ini, selepas pengumuman halal Atomy Mei lalu, masyarakat Islam tidak lagi ragu-ragu tentang status halal Atomy dan mampu bergiat aktif demi membangunkan ekonomi keluarga dan komuniti setempat.

Beliau turut memaklumkan bahawa menerusi platform Atomy itu sendiri, ia boleh dijadikan sebagai satu wadah masyarakat secara keseluruhan mengatasi masalah ekonomi yang kini semakin membelenggu negara.

Ia satu peluang amat baik bagi ummah yang mengurangkan jurang perbezaan ekonomi.

Beliau pada masa sama turut menasihatkan sebarang perbezaan pendapat, keraguan dan lain-lain isu berbangkit berkenaan syarikat dibawa kepada Lembaga penasihat sedia ada agar dapat meminimumkan keresahan di kalangan masyarakat.

Katanya lagi, beliau akan bekerjasama dengan semua pihak berautoriti agama seperti Jakim dan Jabatan Mufti Negeri di seluruh negara dalam masa terdekat bagi merungkaikan masalah dan persepsi yang tercetus berkenaan syarikat berkenaan.

Dapatlah dirumuskan di sini bahawa industri jualan langsung di negara ini antara industri yang kekal berdaya saing dan menjadi sumber pendapatan negara.

Namun demikian, pemantauan oleh pihak berautoriti dalam mengawal industri ini memainkan peranan penting.

Justeru, kerjasama erat di pihak yang berkepentingan amatlah diharapkan bagi memberikan impak positif dalam industri ini terutama kepada pihak pengguna.

Pematuhan syariah merupakan salah satu prasyarat tambahan yang boleh digunapakai seperti sijil halal serta pematuhan syariah dan ia perlulah dikuatkuasakan oleh pihak berautoriti dalam memastikan ‘iklim’ industri ini berada dalam keadaan yang sihat serta dijauhkan dari isu-isu yang cenderung kepada perang perdagangan.
