U.S. Border Patrol say there are ‘no plans’ to dismantle the razor wire installed by the state of Texas along the southern border despite an ongoing legal battle between the Lone Star State and the Biden administration.

Texas is currently entangled in a multifaceted legal clash with the federal government concerning the security of the Texas-Mexico border.

The legal challenges include the federal government’s objection to Texas’ recent seizure of Shelby Park near Eagle Pass, ongoing lawsuits regarding the removal of razor wire erected by Texas, and the placement of buoys in the Rio Grande that deliberately block migrants swimming across.

Texas contends that it is acting in ‘self-defense’ against what it characterizes as a migrant ‘invasion.’

Earlier this week, the Supreme Court ruled in favor of the administration by granting an emergency appeal to permit agents to continue cutting the border wire set up by Texas, overturning a lower court’s decision.

But Texas has continued to reinforce the border and has signaled its refusal to comply with the administration’s demand to vacate the Shelby Park area.

Texas Governor Abbott has asserted the state’s ‘right to self-defense’ against what he has termed a migrant ‘invasion,’ declaring: ‘[President Biden’s] actions have caused an unprecedented invasion that we must defend against.’

The Biden administration maintains Texas is impeding the federal enforcement of immigration law.

A spokesperson for the Department of Homeland Security (DHS) stated this week: ‘Enforcement of immigration law is a federal responsibility. Rather than helping to reduce irregular migration, the State of Texas has only made it harder for frontline personnel to do their jobs and to apply consequences under the law. We can enforce our laws and administer them safely, humanely, and in an orderly way.’

Several Republican governors have expressed support for Texas to continue the standoff between the state and the federal government with a senior CBP official telling Fox News the relationship between Texas and Border Patrol officials on the ground remains ‘strong.’

‘While this issue plays out in the courts, the relationship between Border Patrol, Texas DPS [Department of Public Safety], & TMD [Texas Military Dept.] remains strong,’ the official said.

‘Our focus is and will always be the mission of protecting this country and its people. On the ground, we continue to work alongside these valuable partners in that endeavor.’

The official continued: ‘Bottom line: Border Patrol has no plans to remove infrastructure (c-wire) placed by Texas along the border. Our posture remains the same. If we need to access an area for emergency response, we will do so. When that happens, we will coordinate with Texas DPS & TMD.’

Meanwhile President Joe Biden said on Friday night that the border deal being negotiated in the U.S. Senate was the ‘toughest and fairest’ set of reforms possible and vowed to ‘shut down the border’ the day he signs the bill.

Specifically, the White House has agreed to new limits on asylum at the border, including the creation of an expulsion power that would allow migrants who cross the U.S.-Mexico border illegally to be rapidly returned to Mexico if migrant encounters surpassed 5,000 per day.

‘What’s been negotiated would – if passed into law – be the toughest and fairest set of reforms to secure the border we’ve ever had in our country,’ Biden said in a statement.

‘It would give me, as President, a new emergency authority to shut down the border when it becomes overwhelmed. And if given that authority, I would use it the day I sign the bill into law,’ he said.

If encounters passed 5,000, the use of the expulsion authority would become mandatory, according to the sources who requested anonymity to discuss details of the private negotiations.

Under the new bill, migrants trying to claim asylum would still be able to do so at legal border crossings if the expulsion power was in effect, one of the sources said.

The U.S. would be required to allow at least 1,400 migrants per day to approach legal crossings to claim asylum if the expulsions were in effect, the source added.

The bill aims to resolve asylum claims in six months without detaining migrants, the source said, faster than the current process, which can take years.

Trump, however, took to social media last week to warn against any deal that fails to deliver everything Republicans want to shut down border crossings.

Biden also urged Congress on Friday to provide the funding he asked for in October to secure the border.

‘This includes an additional 1,300 border patrol agents, 375 immigration judges, 1,600 asylum officers, and over 100 cutting-edge inspection machines to help detect and stop fentanyl at our southwest border,’ the president said.   

U.S. House Speaker Mike Johnson who is a Republican said the deal is ‘dead on arrival’ in its current form.
