Mitchell Cole, Prime Minister Scott Morrison’s nephew, fails to show up to court on building charges

Prime Minister Scott Morrison’s nephew was a no-show at court today, a week after NSW’s business watchdog slapped him with criminal charges.

Mitchell James Cole was due to face Parramatta Local Court today after NSW Fair Trading served 20 charges on the 29-year-old, in relation to his building company.

Mr Cole, who is the nephew of Mr Morrison by marriage through his wife Jenny Morrison, has been working in the suburbs of Sydney over the past few years.

However his building company has repeatedly been in hot water, with Fair Trading fining Mr Cole on six separate occasions.

This is the first time the department has laid criminal charges against the company.

He is facing 20 charges, including multiple charges of do residential building work when unlicensed, multiple charges of demand, receive payment for building without insurance, multiple charges of ontract to do residential building work without licence and one charge of accept payment not supply goods/services in time.

The builder was due to face court for the first time today however when his name was called at 10.30am, Mr Cole was a no-show.

A lawyer for Fair Trading confirmed with Magistrate Peter Feather that Mr Cole had been served his court attendance notice and was aware he was supposed to be there.

The lawyer, who refused to give his name, also said Mr Cole claimed to be legally represented but Fair Trading had not been told who that was.

The Fair Trading lawyer and Magistrate Feather briefly considered putting out a warrant for Mr Cole’s arrest due to his non-appearance at court.

However, the pair then agreed to give the 29-year-old a second chance to show up for court.

Magistrate Feather adjourned his matter for two weeks, issuing a warning to Mr Cole.

“It is likely a warrant will be issued for his arrest on the next occasion, (if he fails to appear again),” he said.

Mr Cole has been in Fair Trading’s sights for years.

In November last year, a group of Sydneysiders spoke to A Current Affair about Mr Cole.

Fay Voyiatsis said the builder had name dropped the Prime Minister to her numerous times.

She also said he showed her pictures of him with Mr Morrison, which showed them sitting together with family at his home at Kirribilli House over Christmas.

“He showed us pictures of him and his family, including his uncle Mr Scott Morrison, having Christmas together,” she said.

In a statement to A Current Affair last year, Mr Morrison said: “Mitchell is my nephew by marriage and a result occasionally attends family events. However, that is the extent of contact I have with Mitchell.

“Mitchell, like anyone else, should be held fully accountable for any of his actions.

“No one should have to go through what you have experienced.”

Mr Cole is due to appear at Parramatta Local Court on June 25.
