KOTA KINABALU: A van driver was sentenced to 15 years’ imprisonment plus six strokes of the rotan for sexually abusing a 14-year-old boy.
Agoes Han Suin, 35, was ordered to serve his custodial sentence with effect from today.
Sessions judge Elsie Primus also ordered him to be placed under police supervision for three years after serving his sentence.
Agoes was found guilty of sexually abusing the boy at 7.30am on Dec 16, 2017, at a house in Kota Belud.
The prosecution had produced seven witnesses during the hearing while three witnesses testified during the defence stage.
Earlier, apart from seeking leniency, counsel Al Hafidz Lokman, who represented Agoes, asked for a stay of execution, saying among other things that the accused needed medical treatment due to his health problems.
Lokman also said that the unvaccinated accused was not advised by the doctor to get Covid-19 vaccine due to his health condition.
The prosecution objected, arguing that there was no official report or medical report tendered by the accused.
The court, however, granted Agoes’s application for a stay of execution pending an appeal to the High Court, on the condition that the notice of appeal is filed latest by Monday.
Elsie said the bail sum of RM10,000 deposited by the accused in court with one surety shall remain in court until the disposal of the appeal. The accused must also report to the Kota Belud police station once a month.
Agoes is also prohibited from leaving his residential address and if he wishes to move or leave the district where he resides, the accused must inform the said district police chief.
Elsie ordered the defence to submit the accused’s official medical report and fixed Oct 18 for e-review to monitor the progress of the case.
