Long Island man admits to selling fentanyl used by addict in fatal overdose


A Long Island drug dealer admitted to selling fentanyl to an addict who fatally overdosed on the drugs during a virtual narcotics anonymous meeting, prosecutors said.

Vito Frabizio, 33, pleaded guilty Thursday in connection to the tragic death of the West Babylon man who was working to turn his life around, according to the Suffolk County District Attorney’s Office.

The overdose victim, Frank Cairo, was found dead on his bed by his live-in girlfriend in March 2022. Police recovered two bags of fentanyl and a mixture of fentanyl and heroin in the home, prosecutors said.

Cell phone data obtained by police indicated that Frabizio sold the bags of drugs to the victim, according to the district attorney.

Suffolk District Attorney Raymond Tierney slammed the dealer for taking advantage of the 51-year-old victim who wanted to improve his life.

“This defendant exploited the addiction of the victim, who was trying to get clean, by selling him deadly fentanyl, which resulted in that victim’s death,” he said in a statement.

One day after Cairo’s death, an undercover Suffolk County police officer got in touch with Frabizio, of Deer Park, with the two later meeting at the Sayville Motor Lodge on Sunrise Highway.

At the motel, Frabizio sold the undercover cop 1/8 of an ounce of fentanyl and more than 1/8 of an ounce of cocaine, the DA’s office said, leading to his arrest.

Police recovered fentanyl and cocaine, two digital scales and almost $4,000 in cash in the motel room.

Frabizio was later released at his arraignment because he wasn’t facing any bail eligible charges, prosecutors said.

While he was on supervised release, a week after his arraignment, Frabizio was again contacted an undercover Suffolk officer along with a co-defendant to arrange the sale of fentanyl and cocaine to the officer.

Frabizio and his accomplice were busted mid-sale on more narcotics offenses, prosecutors said. A search of his West Babylon apartment seized more fentanyl, including almost 30 blue tablets of it, and cocaine.

Tierney pointed to the bail reform laws passed in 2019 that allowed Frabizio to remain out of jail while up on drug charges the first time around.

“We were only able to lock this defendant up due to the dogged work of the Suffolk County Police Department,” he said.

Frabizio pleaded guilty to three counts of third-degree criminal sale of a controlled substance, including a narcotics sale leading to an overdose death, and one count of criminally using drug paraphernalia in the second-degree, the district attorney’s office said.

He originally faced dozens of charges when Tierney announced his arrest during an April press conference. Tierney said the case was emblematic of the scary drug problem engulfing the area.

His sentencing is scheduled for Nov. 18.

The attorney representing Frabizio did not immediately get back to the The Post.
