SC Says ‘Govt’s Eyes Closed’ On ‘Misleading’, ‘False’ Ads By Ramdev’s Patanjali, Seeks Absolute Ban

The Supreme Court on Tuesday strongly chided Centre over failing to act against “misleading and false” advertisements by Patanjali Ayurved. “The government is sitting with its eye closed,” the apex court said.

The Supreme Court, last year in November, objected to the ‘false’ and ‘misleading’ claims by Yoga Guru Ramdev co-owned company Patanjali Ayurved in advertisements about its medicines.

Besides, a show cause notice has been served to Ramdev and Acharya Balakrishnan as to why contempt of court proceedings should not be initiated against them, the Bar and Bench reported. The reply from the due in this matter has been sought within two weeks.

The court also expressed its dissatisfaction over the Centre’s role in this regard, asserting that the ads should be stopped immediately. It asked the government to file an affidavit on the steps taken to prevent the incorrect representation of medicines by companies in the media. “As of now nothing doing we will say. Full restraint! We have to show some. Prohibition we have to do it! Full stop, zero. No media, no print,” the media outlet quoted the judge as saying.

The SC order refers to the January 15 anonymous letter addressed to CJI and Justice Amanullah (and one other judge) regarding the false advertisements issued after the passing of the last order. It refers to the Drugs and Magic Remedies (Objectionable Advertisements) Act and alleged violations in the instant case.

The IMA filed a writ petition against Patanjali alleging that the latter was running ads portraying modern medicines in a bad light. The company, however, continued its fervent campaign against the allopathy despite the Supreme Court order.

In November 2023, the top court warned Patanjali against the ads, adding that a fine of Rs 1 crore would be unleashed upon the subordination of the orders. “All false and misleading advertisements by Patanjali Ayurved have to stop immediately. This court will take such infractions very seriously and will consider imposing costs of up to Rs 1 crore on every product for which a false claim is made that it can cure a particular disease,” the court had said.
