Deutschlands Kanzler in spe, Olaf Scholz (SPD), forderte am Dienstag für das Land eine allgemeine Impfpflicht. Das berichtet «Der Spiegel». Demnach sagte Scholz bei aktuellen Länderberatungen: «Ich als Abgeordneter werde ihr jedenfalls zustimmen, um das ganz klar zu sagen.» Am späteren Nachmittag doppelte der Sozialdemokrat bei «Bild»-TV nach und erklärte, dass ein Gesetzgebungsverfahren noch in diesem Jahr eingeleitet werden solle.

Die Impfpflicht solle beginnen, «wenn jeder eine realistische Chance hatte, sich zweimal impfen zu lassen. Das müsste uns bis Anfang Februar gelingen.» Scholz befürwortete eine «fraktionsübergreifende Initiative».

Angesichts der neuen Omikron-Variante und der Wucht der vierten Welle wird in den Bundesländern der Ruf nach härteren Massnahmen lauter. Deswegen beraten die Ministerpräsidentinnen und Ministerpräsidenten mit Kanzlerin Angela Merkel und ihrem designierten Nachfolger Olaf Scholz seit 13 Uhr telefonisch miteinander.

Beschlüsse seien für heute nicht geplant, hiess es.

Wird «epidemische Lage» erneut festgestellt?

Diskutiert werden mehrere Optionen. So könnte die erst gerade ausgelaufene «epidemische Lage von nationaler Tragweite» vom Bundestag wieder festgestellt werden und damit auf einen Schlag eine Rechtsbasis für alle bisherigen Krisenmassnahmen schaffen.

Die Ampel-Parteien SPD, Grüne und FDP hatten die epidemische Lage von nationaler Tragweite am 25. November auslaufen lassen und mit ihrer neuen Mehrheit im Bundestag stattdessen das Infektionsschutzgesetz reformiert: Künftig können die Länder keine Lockdowns, flächendeckende Schulschliessungen und Ausgangssperren mehr verhängen.

Bundeswehrgeneral als Beschleuniger

Möglich wäre auch, die verkleinerte Massnahmenliste der Ampel-Fraktionen zu erweitern, unabhängig von der epidemischen Lage. Derzeit schliesst die Liste etwa pauschale Schliessungen von Gaststätten und Läden oder Inlandsreisebeschränkungen in einem ganzen Bundesland aus.

Scholz stellte in der Runde auch Generalmajor Carsten Breuer als Leiter des geplanten Krisenstabs zur Corona-Bekämpfung vor. Dieser soll unter anderem die Booster- und weiteren Corona-Impfungen in Deutschland beschleunigen. Breuer führt bei der Bundeswehr sonst das Kommando Territoriale Aufgaben.

Politische Entscheidungshilfe durch Verfassungsgerichts-Urteil

Auf der Tagesordnung der Schaltkonferenz mit den Ministerpräsidentinnen und Ministerpräsidenten stand auch die Diskussion über die am Vormittag verkündete Entscheidung des Bundesverfassungsgerichts.

Dieses hatte entschieden, dass die zentralen Massnahmen der sogenannten Corona-Notbremse des Bundes aus der dritten Pandemie-Welle verfassungsrechtlich nicht zu beanstanden sind. Mit seiner Entscheidung habe das Gericht in Karlsruhe politische Entscheidungshilfe gegeben, schreibt Tagesschau.de.

Je kürzer die Massnahmen, umso eher die Freiheitsbegrenzung

Das Gericht wies mehrere Klagen ab, die sich gegen die im Frühjahr angeordneten Kontakt- und Ausgangsbeschränkungen sowie Schulschliessungen richteten. Die Grundrechtseingriffe seien durch «überragend wichtige Gemeinwohlbelange» gerechtfertigt gewesen.

Kontaktbeschränkungen seien ein geeigneter Weg gewesen, um die Menschen zu schützen. Der Gesetzgeber habe damals keine anderen Mittel als genauso wirksam angesehen, und das zu Recht, so das Gericht. Und man müsse ja auch sehen, dass die Bundesnotbremse schon wieder Ende Juni ausgelaufen ist. Die Freiheit könne umso eher begrenzt werden, je kürzer die Massnahmen dauerten.
