Impf-Passus kann Obwaldner Gesundheitsgesetz nichts anhaben

Obwalden kann sein Gesundheitsgesetz trotz eines umstrittenen Impf-Passus ans Bundesrecht anpassen. Das Stimmvolk hat einem Gesetzesnachtrag am Sonntag deutlich zugestimmt, nachdem überraschend das Referendum ergriffen worden war.

Den Nachtrag zum Gesundheitsgesetz genehmigten die Obwaldnerinnen und Obwaldner mit einem Ja-Stimmenanteil von 59,3 Prozent bei 11’004 Ja gegen 7553 Nein-Stimmen. Die Stimmbeteiligung betrug 72,1 Prozent, wie die Staatskanzlei mitteilte.

Im Kantonsrat war die Vorlage vollkommen unbestritten gewesen, handelt es sich doch bei den meisten Änderungen um Anpassungen ans Bundesrecht. Dass der Nachtrag dem Volk vorgelegt werden musste, liegt am Referendum, das ein Komitee ergriffen hatte. Die 1200 Unterzeichnenden störten sich an der Formulierung, wonach neu der Regierungsrat öffentliche Impfungen durchführen lassen kann.

Bereits heute kann er Impfungen für obligatorisch erklären. Die Gegner argumentierten, das Betreiben von Impfzentren sei vom Bundesrecht bereits abgedeckt. Mit der Änderung werde die Zuständigkeit neu beim Regierungsrat angesiedelt, was stufengerechter sei, als wie bislang beim Finanzdepartement, konterte die Regierung.

Datenaustausch und Patientendossier

Das Referendumskomitee störte sich auch am vorgesehenen Austausch von Personen- und Gesundheitsdaten zwischen dem Kanton und Schulen oder Heimen. Mit diesem sollen in Einrichtungen mit hohem Übertragungsrisiko im Falle von übertragbaren Krankheiten Schutzvorkehrungen getroffen werden können.

Viele der Anpassungen im Gesundheitsgesetz sind auf Änderungen oder Vorgaben des übergeordneten Bundesrechts zurückzuführen, die der Kanton übernehmen muss. Schwerpunkte sind unter anderem Präzisierungen im Bewilligungswesen, die Schaffung der Grundlagen für elektronische Patientendossiers oder die Abgrenzung von Zuständigkeiten.

Der Ausgang der kantonale Abstimmung war insbesondere deswegen ungewiss, weil sie gleichzeitig mit der Änderung des nationalen Covid-19-Gesetzes vors Volk kam. Im vergangenen Juni hatte der Kanton Obwalden das Covid-Gesetz abgelehnt mit fast 57 Prozent Nein-Stimmen. Dieses Mal sagten die Stimmberechtigten Ja zur Bundesvorlage mit 51 Prozent.
