Un jugador brasileño que quedó paralítico tras una colisión durante un partido considera que su disputa judicial constituyó un triunfo para el fútbol, pese a que el máximo tribunal del deporte desestimó el reclamo hecho a su club para que pagara una compensación.
Leandro Padovani perdió su pleito legal contra el club iraní Esteghlal, donde se lesionó en 2018, ante el Tribunal de Arbitraje Deportivo (TAS), informó el martes el sindicato global de futbolistas FIFPRO.
Sin embargo, Padovani y FIFPRO consideraron también que el caso es un triunfo porque estableció la posibilidad de que los jugadores presenten reclamos futuros por lesiones, ante el organismo rector del fútbol mundial.
“Éste es un caso relevante para las futuras generaciones de futbolistas”, dijo Padovani a The Associated Press el lunes, en ua entrevista desde Brasil, antes de que se anunciara el fallo de la corte. “Si otro jugador se lastima como yo, habrá jurisprudencia para protegerlos”.

Por medio de un comunicado, FIFPRO manifestó su “decepción por el fallo del TAS, acerca de que el club no era responsable por la lesión que puso fin a la carrera del jugador”.
Padovani, quien tiene ahora 39 años, se mudó de Brasil en 2012 para jugar en la Liga Pro del Golfo Pérsico. El Esteghlal fue el cuarto equipo del zaguero en Irán.
La lesión severa en la cabeza y el cuello se presentó debido a una colisión con un compañero durante un partido disputado en febrero de 2018, explicó FIFPRO. Añadió que no se inmovilizó debidamente el cuello de Padovani.
“El TAS consideró que el club no tuvo la culpa, pese a que me transportó de la cancha al hospital sin precaución alguna. Ahora estoy cuadripléjico”, dijo Padovani a la AP.
Esteghlal “no tenía póliza de seguro para cubrir esta lesión, una medida que es común en muchas otras jurisdicciones y que debería ser obligatoria en todo el fútbol profesional. Ello dejó al jugador en una posición inaceptable e inconcebible”, indicó FIFPRO.
El caso mediante el que Padovani exigía una compensación por la lesión fue desestimado por un panel de disputas de la FIFA, “sobre la base de que no era competente para considerar el reclamo”, indicó el sindicato.
Si bien los jueces del TAS que atendían el caso de Padovani determinaron que no se había demostrado que las acciones del club hubieran causado las lesiones, decidieron también que la FIFA debía atender esos reclamos en el futuro, indicó FIFPRO.
“Ésta es por lo tanto una decisión significativa para los jugadores lesionados por el trato negligente de sus clubes” manifestó el sindicato con sede en Holanda.
Padovani, quien está casado y tiene un hijo bebé, compite ahora en natación paralímpica. Su meta es llegar a los Juegos de París en 2024.
“No tuve seguro ni apoyo del club ni de la FIFA”, dijo sobre su caso legal. “Éste es un parteaguas para los casos de lesiones graves”.
