KOTA KINABALU: Four men who were jointly charged with causing the death of a man in Ranau five years ago were freed by the Sessions Court here today.
Fedyan Julian, 28, Erodes Paramin, 47, Addily Miki,37, and Enzo Thresto Kalius, 26, were discharged and acquitted by judge Marlina Ibrahim today without their defence being called.
Marlina ruled that the prosecution had failed to establish a prima facie case and hence, all the accused were discharged and acquitted.
They were accused of committing culpable homicide not amounting to the murder of Mesnan Yusnin, 25, at the roadside of Kampung Simpangan Poring in Ranau between 1.55am and 3am on April 24, 2016.
They were tried under Section 304(a) of the Penal Code, read together under Section 34 of the same Code, which carries a jail term of up to 30 years, liablle to a fine upon conviction.
The prosecution had called 24 witnesses since the trial commenced on Feb 16, 2017.
During the trial, it was revealed that the cause of death was a chest injury, caused by a rectangular-shaped hard, blunt object.
Counsels Dominic Chew and Luke Ressa Balang represented the four men while deputy public prosecutor Adibah Saiful Bahri prosecuted the case.
