EEUU desestima demanda de México contra fabricantes de armas

Un juez estadounidense desestimó el viernes la demanda presentada por el gobierno mexicano en la que acusaba a fabricantes de armas estadounidenses de contribuir al derramamiento de sangre en México.

Según la decisión del magistrado del distrito de Massachusetts, las leyes estadounidenses no permiten este tipo de demandas.

“Este tribunal no tiene autoridad para ignorar una ley del Congreso”, dice la sentencia firmada por el juez F. Dennis Saylor. “Tampoco es apropiado que forje estrategemas para evitar los mandatos legales, aún cuando los señalamientos de la demanda pueden evocar una respuesta empática”.

La ley a la que hace mención el magistrado es conocida como Protection of Lawful Commerce in Arms Act (PLCAA) y fue aprobada en 2005. Tal y como argumentaban los fabricantes, el juez consideró que impide que ellos rindan cuentas por el uso que se pueda dar a las armas que fabrican o distribuyen.

México apelará la decisión “y seguirá insistiendo en que el comercio de armas debe ser responsable, transparente y con rendición de cuentas, y que la forma negligente como se venden en los Estados Unidos facilita que los criminales accedan a ellas”, indicó la Cancillería en un comunicado.

El gobierno mexicano sostiene que los fabricantes saben que sus prácticas contribuyen al tráfico de armas a México y lo facilitan. Las empresas demandadas son Smith & Wesson, Barrett Firearms, Beretta, Century International, Colt’s Manufacturing, Glock Inc., Sturm, Ruger & Co y Witmer Public Safety Group.


    La demanda señala que México quiere acabar con los daños que causan los acusados al facilitar el tráfico ilegal de sus armas a los cárteles de la droga y otros criminales en México. Además, refiere que la amplia mayoría de las armas recogidas en escenas de crímenes en México provienen de Estados Unidos.

    En 2019, según estimaciones de la cancillería, al menos 17.000 homicidios estuvieron vinculados con esas armas.

    Los fabricantes y distribuidores demandados han asegurado que existen muchos actores en el negocio de la venta de armas, que es legítima, y que en ese proceso se diluye su responsabilidad. También aseguran que a través de una ley de protección del comercio de armas, el Congreso ha eliminado vías para que los estados les pidan rendición de cuentas.

    Los procuradores de 17 estados de Estados Unidos y más de una veintena de fiscales de distrito habían mostrado su apoyo a la iniciativa mexicana con el argumento que la PLCAA no era un obstáculo a la demanda de México pero el juez consideró lo contrario.
