Draft govt rules on coaching centre ads: No false claims of 100% selection

The Centre Friday unveiled draft guidelines to curb misleading advertisements by coaching institutions, which said that any person engaged with coaching centres will not make false claims, including 100 per cent selection or 100 per cent job guarantee.

The guidelines, drafted by the Central Consumer Protection Authority (CCPA) titled Prevention of Misleading Advertisement in Coaching Sector, released by the Ministry of Consumer Affairs, Food and Public Distribution, sought public opinion within 30 days.

Among various parameters of what constitutes misleading advertisements by a coaching are concealing important information related to name of the course (whether free or paid) & duration of course opted by successful candidate, making false claims regarding success rates, selections or rankings without providing verifiable evidence, and falsely representing students’ success is solely attributable to the coaching.

Also, any person in a coaching will not use names, photos, testimonials or videos of successful candidates in advertisement without successful candidates’ express consent, state or lead the consumers to believe that enrolment in coaching will guarantee the student a rank, high marks, temporary or permanent job, admissions to institutions, job promotions, salary increase, etc.

Before drafting, the CCPA had formed a panel on December 8, 2023 to deliberate on the issue of misleading advertisement in coaching sector. It also held a stakeholder consultation on January 8, 2024.
