Cruise drugs case: Nawab Malik gets bail in defamation complaint filed by BJP man

A special magistrate court in Mumbai granted bail to Maharashtra Cabinet Minister and NCP leader Nawab Malik in a defamation case filed by BJP’s Mohit Kamboj.

At a press conference, Nawab Malik had alleged that Narcotics Control Bureau (NCB) zonal director Sameer Wankhede had let go of Kamboj’s brother-in-law Rishabh Sachdeva because of the BJP leader’s influence. Sachdeva was on the cruise when the NCB claimed to have busted a drugs racket on October 2.

Malik appeared before Magistrate PI Mokashi after the court in Sewri issued proceedings against him on Kamboj’s private defamation criminal complaint. Nawab Malik furnished a personal bond of Rs 15,000 as part of bail conditions.

Representing Kamboj, advocate Faiz Merchant filed an application asking Malik not to speak against Kamboj among other conditions.

However, Malik’s lawyer Ramesh Dube Patil told the court that Kamboj is not espousing his cause, but that of Wankhede and the NCB, and that the matter was already sub-judice before the Bombay High Court.

The court refused to impose the conditions as sought by Kamboj.

Malik attended a cabinet meeting in the morning and rushed to court in central Mumbai, where many of his supporters had gathered. Because of this, even Kamboj could not enter the courtroom.

Merchant told the court that last night, Malik tweeted to invite his party workers and the public to the court to pressure the court and obstruct justice “to lower the majesty of the court.”

“It’s a classic case of contempt due to which we are moving an application for contempt against him.”

Merchant said the gathering was “a gross violation of the State of Maharashtra’s notification of November 27 under the Epidemics act and the Disaster Management Act, not to mention separate offences under sections 188 (disobedience to order by civil servant), 269 (unlawfully spread infection) and 270 (spread of dangerous infection) of the Indian Penal Code.”

Kamboj also registered a complaint before the RAK Marg Police Station against Malik and his party workers.

The Magistrate’s court will further hear the matter on December 30.
