La proposition de loi visant à assouplir les conditions d’octroi des crédits immobiliers a été retirée le 29 avril par son auteur, Lionel Causse, alors qu’elle était débattue à l’Assemblée nationale. Le député Renaissance regrette que son texte ait été trop dénaturé au fil des amendements adoptés.

Un volte-face en bonne et due forme. Alors qu’elle était débattue à l’Assemblée nationale, la proposition de loi du député Lionel Causse (Renaissance), visant à redynamiser le marché du crédit immobilier, a finalement été retirée par son auteur dans la nuit du 29 au 30 avril. Le député souhaitait notamment réformer le Haut conseil de stabilité financière (HCSF), l’organisme qui, depuis 2022, a instauré un taux d’endettement maximum de 35% des revenus nets pour les souscripteurs de crédits immobiliers. «Le texte a été totalement vidé de sa substance. J’ai donc décidé de le retirer», explique le parlementaire à Capital.

Le premier article, qui prévoyait la nomination d’un député et d’un sénateur au sein du HCSF pour le rendre plus représentatif, a été supprimé par les députés. Le socialiste Philippe Brun voyait dans cet article une «politisation excessive» du HCSF donnant «tous les pouvoirs à la majorité présidentielle».

Mais c’est surtout le second article de la loi qui attirait tous les regards. Le texte prévoyait, dans sa version issue de la Commission des finances de l’Assemblée nationale, que le HCSF puisse «fixer les conditions» dans lesquelles les établissements de crédits «peuvent déroger à ses décisions». L’idée de Lionel Causse était de tenir compte de «la réalité du contexte économique». Ainsi, pendant les périodes de faible croissance, le HCSF aurait pu être en mesure de repousser le plafond d’endettement de 35% pour faciliter l’accès au crédit.

«76% des personnes surendettées sont locataires»

Les députés de l’opposition, principalement à gauche, y ont cependant vu un appel au surendettement des ménages. «Je rappelle que 76% des personnes surendettées sont locataires, leur a répondu Lionel Causse lors de l’examen de la proposition de loi en commission, le 10 avril. Si un locataire met 50% de son salaire dans un loyer, on lui dit oui. Si c’est 40% pour un propriétaire, on lui dit non.»

Les députés Renaissance et le gouvernement n’ont pas non plus soutenu le texte. «Le gouverneur de la Banque de France, opposé à la proposition de loi, a su se faire entendre, ironise Lionel Causse. Cela interroge sur la faiblesse du Parlement»
