Le Conseil supérieur de la magistrature (CSM) a été saisi du cas de la juge Hélène Gerhards, a-t-on appris ce vendredi de source proche du dossier. Cette magistrate avait, de manière rarissime, été placée en détention provisoire dans un dossier de banditisme corse début avril, après avoir été mise en examen.

Le CSM, chargé de la discipline des magistrats, a été saisi vendredi dernier d’une demande d’interdiction temporaire d’exercice, une procédure d’urgence, en attendant une saisine disciplinaire au fond.

Contrairement à la procédure habituelle et en vertu d’un « décret de déport », c’est le Premier ministre Gabriel Attal et non le garde des Sceaux qui a saisi le CSM. Éric Dupond-Moretti avait en effet défendu l’ex-mari d’Hélène Gerhards dans son ancienne vie d’avocat, dans une autre affaire.

Des informations contre des travaux au rabais

Début avril, la magistrate Hélène Gerhards avait été mise en examen pour 11 chefs d’inculpation, dont détournement de fonds publics, faux en écriture publique par un dépositaire de l’autorité publique ou encore association de malfaiteurs en vue de la préparation d’un crime ou d’un délit. Elle avait été écrouée, fait rarissime, dans une enquête pour ses liens supposés avec le banditisme corse.

Après 15 jours environ de détention, elle avait été remise en liberté sous contrôle judiciaire avec interdiction d’exercer sa profession, de se rendre en Corse et de contacter les protagonistes de l’affaire. La magistrate, juge d’instruction en Corse de 2010 à 2016, clame son innocence.

Elle est notamment soupçonnée par les enquêteurs d’avoir « rendu des services » à des membres du banditisme insulaire, notamment des informations sur des procédures judiciaires en cours et des conseils juridiques. Et ce en échange de travaux non déclarés et payés au rabais au sein de sa villa de luxe située au sud d’Ajaccio avec son ancien compagnon, un ex-gendarme.

Interrogé début avril sur l’éventualité d’une ouverture d’enquête administrative visant la juge Gerhards, en parallèle de l’enquête judiciaire, Matignon n’avait pas souhaité commenter.
