Esta tarde, el Pleno de la Suprema Corte de Justicia de la Nación (SCJN) ha validado la reforma en el Congreso de la Ciudad de México respecto a la Ley Orgánica de la Fiscalía General de Justicia de la CDMX, conocida popularmente como “Ley Godoy”. 

Esta nueva modificación a la Ley, dará la posibilidad de reelección para la persona titular del cargo de Fiscal, sin la necesidad de tener que participar en una terna de candidatos como se hacía anteriormente.

La reforma, promovida por Morena en la Ciudad de México, tiene como objetivo principal modificar el procedimiento para la ratificación de la persona titular de la Fiscalía, lo que podría beneficiar a la ahora titular, Ernestina Godoy, en su intento por permanecer en el cargo por otro período de cuatro años.

   

Validación de la Corte y modificaciones en el proceso de ratificación

El proyecto del ministro ponente, Juan Luis González Alcántara-Carrancá, recibió el visto bueno de la SCJN, respaldando el decreto publicado el 17 de mayo de 2023. A partir de esta reforma, se han modificado los procedimientos de ratificación para diversas figuras dentro de la Fiscalía General de Justicia local, así como las atribuciones del Consejo Judicial Ciudadano.

Durante su análisis, los ministros determinaron que el Congreso local tenía la libertad de configurar sus propias instituciones de procuración de justicia, sin violar procesos legislativos.

Esta decisión destaca la idoneidad de las atribuciones conferidas al Consejo Judicial Ciudadano, subrayando su papel fundamental en la consolidación de un sistema de justicia transparente y receptivo a las inquietudes ciudadanas.

El fallo también resalta la legislación aplicable a las Fiscalías Especializadas para la atención de delitos electorales y contra la corrupción, validando la autonomía de estos órganos conforme a la Constitución local.

Además, las facultades otorgadas al Consejo Judicial Ciudadano para operar presencial o remotamente fortalecen su flexibilidad y capacidad de respuesta ante las necesidades del sistema de justicia.
