Squatters have taken over an historic school house at South-West Rocks, near Kempsey, New South Wales.
The site is listed for sale in Sydney next week, to cover almost $1 million in Kempsey Aboriginal Land Council debt.
Land council administrator Andrew Hoholt says he has been forced to seek a development application to demolish the building as a way to evict the squatters.
He says police will not remove the trespassers without a guarantee they will not move back in.
Mr Hoholt says as well, Country Energy will not disconnect the electricity because as far as it is concerned there is a legal contract to supply power to a tenant.
“That scared the living daylights out of me from a liability perspective to the land council,” he said.
“The first thing I did was ring the NSW Police Service and ask them to remove these trespassers.
“The police service has refused to do so unless I could give them a guarantee that once they removed the trespassers they wouldn't be able to re-occupy the premises.
“Obviously the only way to do that is to have the building demolished.
“I did query with Country Energy, 'who gave you the right to connect power to this property in the first place?'”
