La exfiscal suprema Bersabeth Revilla calificó de “consistente” la información sobre su caso que se ha conocido gracias al informe de la magistrada de la Junta Nacional de Justicia, Inés Tello, y por el operativo Valkiria XI, en el contexto de las investigaciones a Patricia Benavides. “Se han detallado todos los elementos probatorios”, sostiene.

-En la disposición que autoriza los allanamientos para el operativo Valkiria XI se señala que la exfiscal de la Nación, Patricia Benavides, y sus exasesores, Jaime Villanueva y Miguel Girao, coordinaron para alejarla de las investigaciones a la jueza Enma Benavides. ¿Encuentra consistente lo que se relata ahí?

-Es muy consistente. De los indicios iniciales que motivaron la denuncia que formulé ante la Junta Nacional de Justicia (JNJ) y el Poder Judicial, hemos pasado a indicios reveladores. La disposición detalla todos los elementos probatorios, por los cuales mi cese, mi remoción como fiscal suprema provisional, fue un acto mafioso, de corrupción entre varios actores encabezados por Patricia Benavides, junto con Villanueva y Girao, Abel Cartolín Príncipe…

-Cartolín es quien emitió el informe de baja productividad en su contra.

-Así es. Y para consolidar ese acuerdo se les unió la fiscal Azucena Solari.

-Quien la reemplazó.

-Correcto. Y se fue a los días para ser nombrado el doctor Uriel Terán.

-¿Qué sintió cuando leyó el documento de Valkiria XI?

-Un shock. Sentí eso. Sentí también que se me reivindicaba. Igual que me reivindicó el informe de la magistrada de la JNJ, Inés Tello. Porque lo que yo denuncié se está acreditando, en el nivel administrativo y el nivel penal. Mi dicho es uno en defensa de la verdad, mis 41 años de profesional me avalan. ¿Sabe por qué antes no salía a hablar públicamente?

-Imagino porque esperaba que las investigaciones dieran resultados.

-Porque en las investigaciones se debe respetar la reserva de los casos. Ese fue mi compromiso. Hay que respetar la ley. Ahora que se ha acreditado probatoriamente lo que denuncié, he decidido salir a hablar. Es cierto que las investigaciones demoran. Pero mi caso sí era muy grave.

-Todo empezó cuando usted se hace cargo de las investigaciones a Enma Benavides.

-Su caso estaba en la fiscalía de corrupción y como yo fui nombrada en la fiscalía suprema especializada en delitos de corrupción de funcionarios se me envió su carpeta en julio o agosto de 2019. Formé mis equipos de investigación, fuimos recolectando indicios, luego información reveladora y por eso es que pedí medidas cautelares que fueron declaradas fundadas y luego confirmadas por la Suprema. Es a raíz de eso que se empiezan a realizar todas estas maniobras mafiosas contra mí.

-Una vez que Patricia Benavides es nombrada como fiscal de la Nación.

-Al mes. Tenían todo planeado. Cuando se expidió mi resolución de cese como fiscal suprema, es el mismo día que se anuncia la captura de Bruno Pacheco. Fue para que mi salida pase desapercibida. Eso lo señala Jaime Villanueva.

-Entiendo que Patricia Benavides habló con usted sobre su hermana Enma.

-Habló, aunque ella lo niega. A mí me avala la verdad. Yo no tengo ni amistad ni enemistad con la señora, pero pidió hablar conmigo, yo accedí. Se sentó, me dijo que su hermana ya había sido denunciada ante la OCMA, que había archivado el caso. Yo le dije que la OCMA es la parte administrativa y que a mí me corresponde, como titular de la acción penal, seguir investigando. Ella me respondió: “Mi hermana es inocente, doctora”. Yo le dije que privilegio la presunción de inocencia y que la culpabilidad la determina el Poder Judicial. Entonces, ella se levantó muy molesta y se fue. Todo lo observó mi secretaria.

-Esa conversación marcó su destino.

-Marcó mi destino, por supuesto. Pero un destino que previamente había sido acordado.

-La historia de las denuncias contra Patricia Benavides como fiscal de la Nación empieza con usted. Y ahora es como si se terminara de cerrar el círculo.

-Siento eso. El círculo se ha cerrado. Lamentablemente, se ha dañado mucho la imagen del Ministerio Público (MP). Mis colegas me escriben diciendo que los ciudadanos ya no creen en ellos. Teníamos un lema: “El MP es la luz que no se apaga”. Hoy sienten que se ha apagado por todos los hechos acontecidos.

-¿En qué estado quedaron las investigaciones a Enma Benavides?

-Eso ya lo tiene que ver la Segunda Fiscalía Transitoria donde yo he sido cesada. Las investigaciones tienen que continuar, sea lo que sea. Mi intención no era perseguir por perseguir. El fiscal lo que hace es reunir medios de prueba.

-¿Cuánto había avanzado usted en el caso?

-Había avanzado bastante. Quedaron pendientes diligencias muy importantes que ahora mis colegas fiscales están actuando. Han pedido que se les dé más tiempo porque el plazo concedido es muy corto. Hay que esperar que así sea.

-¿Qué piensa que ocurrirá con Patricia Benavides? ¿Debería ser cesada?

-Yo lo pedí en mi denuncia.

-Ella dice que todo es una confabulación en su contra.

-¿Pero qué confabulación puede haber? Ella ha hablado de venganza política. ¿Venganza política? ¿De mi parte? ¿De qué naturaleza, de qué origen? Yo solo soy una ciudadana que ha ejercido su función fiscal con honradez y responsabilidad. He ganado bonos fiscales por descarga procesal y, de pronto, se me dice que soy una fiscal ociosa, que no trabajo lo suficiente y que me tengo que ir. ¿Eso no es un agravio en contra de mi persona, de mi trayectoria, no es una ofensa para mi equipo que me apoyaba día y noche, incluso en pandemia?

-¿Qué piensa de Patricia Benavides?

-Que actuó dolosamente en mi agravio.
