Benjamin Hoffmann jury hears from Buff Club and Jolly Street witnesses in Darwin CBD shooting trial

A regular at a Darwin pub where prosecutors allege Benjamin Glenn Hoffmann murdered his third victim has told a jury he tried to wave over a police officer after finding a dead body, but says the officer stayed by his car.

Mr Hoffmann is accused of murdering four men during an alleged shooting spree on June 4, 2019.

Buff Club patron Malcolm Smith today told a Northern Territory jury he found Michael Sisois’s body in the car park of the pub after hearing a loud bang.

CCTV footage played to the jury showed Mr Smith looking at the body and then indicating to someone nearby to come to the car park.

Mr Smith told the court he was attempting to call over a police officer who was about 15 metres away.

“I motioned and spoke to the officer saying … somebody had been shot in the car park,” he said.

Mr Smith told the court the officer asked him: “Is the gunman still in the car park?”

The jury heard Mr Smith told the officer the gunman had left in a white ute and the policeman replied “OK”, but did not come any closer.

Officer feared scene ‘fraught with danger’

Senior constable Merwan Kazem on Monday told the jury he was outside the Buff Club in a police car on the afternoon of June 4.

Senior constable Kazem told the jury he heard a gunshot but did not enter the venue until two additional officers arrived, more than three minutes after Mr Smith asked for help.

Senior constable Kazem told the court there was “some confusion” and he thought it would be “fraught with danger” at the scene.

NT Police constable Kevin Rankine told the court he and his partner responded to a call for assistance at the Buff Club.

The jury heard the three officers then entered the car park together with “guns drawn”.

Jolly Street death probed

The jury was also shown CCTV footage, which prosecutors allege shows Mr Hoffmann arriving at Darwin Recycling on Jolly Street in a white ute, shortly after 6:00pm on June 4.

In their opening statement last week, Crown Prosecutor Lloyd Babb SC said the footage shows Mr Hoffmann entering the premises wearing a hi-vis shirt and carrying a gun and later leaving shirtless and “smeared” in blood. 

Prosecutors allege Mr Hoffmann murdered security guard Robert Courtney while at the site.

Johnny Reid told the court he was living at the recycling centre, in a room near Mr Courtney, on the night of the alleged murder.

Mr Reid said he saw a man walking around the premises with a gun and feared for his life.

Mr Reid told the court the man did not look angry and at one stage they made direct eye contact.

After this, Mr Reid said he “took off” and ran down the street in his underpants.

The witness told the court as he fled the scene, he heard yelling and gunshots behind him.

“It frightened the living daylights out of me,” Mr Reid said.

Alleged gunman ‘on a mission’

Peter Boden, who also lived at the Jolly Street site, described the alleged gunman to the court as “very hurried” and “on a mission”.

Mr Boden said he watched the man fire about four gunshots into two rooms, heard him re-load his gun and then heard another four gunshots.

In a triple-0 call made on the night, played to the court, the operator can be heard asking Mr Boden: “How do you know someone’s been shot?”.

Mr Boden replied: “Because I could hear him screaming in agony”.

The jury heard the police arrived shortly afterwards but left the scene after learning the gunman had moved on.

Mr Boden told the court that when he re-entered the property after the police left, he found Mr Courtney’s body.

Mr Hoffmann has pleaded not guilty to all 14 charges against him.

The trial is expected to continue for another eight weeks.
