Building temple is another way to grab public land: Gujarat HC
AHMEDABAD: In response to the fervent plea of locals to spare a temple from demolition to make way for a public road under a town planning scheme, the chief justice of Gujarat HC on Thursday observed “this is how people emotionally blackmail everyone”. “Building a temple is another way of grabbing public land in India,” Chief Justice Sunita Agarwal said.
The case revolves around an appeal by 93 households in Chandlodia opposing the construction of a public road in a draft TP scheme. After a single judge dismissed their challenge to the scheme, they appealed before the division bench. Despite assurances from Ahmedabad Municipal Corporation that no houses would be demolished, residents sought to protect a temple situated along the planned road, citing emotional attachment as entire community had contributed to building it.
“I must stay that this is how you emotionally blackmail everyone. You encroach upon public property. And this is happening everywhere,” CJ said.
The CJ further said that the land on which the temple is situated is not owned by the appellants. “By saying that the temple will be removed, you are trying to cash in on emotions (claiming that people will be affected).”
The judge then elaborated on the method of protecting illegal constructions by trying to convert houses into a temple. “You put up some signs outside the house and make it a temple. This is another way of land grabbing in India…”
In its interim order, the bench of CJ and Justice Aniruddha Mayee continued interim protection granted against demolition. Further hearing has been posted on March 14.
